PCR2001146a RESOLUTION #P.C. 146-2001 APPROVAL OF AN ACCESSORY STRUCTURE FOR W198 S10795 RED OAK COURT (TAX KEY NO. 2287.023.009) THE STYS PROPERTY LOCATED AT WHEREAS, On September 10, 2001 a site plan and construction information was submitted by Kenneth Stys to construct a 600 square foot accessory structure at the property located at W198 St0795 Red Oak Court. and WHEREAS, The property is zoned RS-2, Suburban Residence District, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.1, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable first floor area and said area contains 1,202 square feet which would allow 721 square feet of total square footage of accessory buildings, and WHEREAS, One outbuilding currently exists on the parcel totaling 120 square feet, and WHEREAS, The location of the proposed structure meets the required setback and offsets, the ultimate height is limited to 15 feet, the architectural appearance would be compatible with the applicant's surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities, and WHEREAS, The structure will be constructed with T-111 siding and a fiberglass shingled roof, and colors have not been indicated. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a structure not to Section 4.05 (1) B and 6.1 1 (2). exceeding 600 square feet for the Stys property at W198 S10795 Red Oak Court in accordance BE IT FURTHER RESOLVED, That the accessory structure colors will complement the existing residence BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
