PCR20011450 RESOLUTION #P.C. 145-2001 APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR A STEALTH WIRELESS COMMUNICATIONS FACILITY FOR TELECORP REALTY ON THE WEPCO FACILITY AT S79 W16464 WOODS ROAD I ADJACENT TO TAX KEY NO. 2218.990.001) WHEREAS, Plans were submitted on September 6, 2001 by WFI representing Telecorp facility on the WEPCo right-of-way located abutting S79 W16464 Woods Road (adjacent Realty, Inc. for a Building, Site and Operation Plan for a stealth wireless communications to the north side of Tax Key No. 2218.990.001), and WHEREAS, The facility is proposed to be located on a guy tower for an existing WEPCO transmission tower, and said structures are exempt from the height requirements of the zoning district, and WHEREAS, The proposed 97-foot tall guy tower will replace the existing 80-foot pole, and WHEREAS, Wireless Communications Facilities which are proposed to be located on existing WEPCO transmission towers and appurtenances are classified as stealth facilities and are permitted subject to Plan Commission approval of a Building, Site and Operation Plan, and the petition conforms to the bulk requirements of the District, and WHEREAS, Said property is currently zoned RS-2. Suburban Residence District, and with the adopted 2010 Street System Plan. WHEREAS, Access to the site is via the WEPCo right-of-way, and there is no conflict WHEREAS, The public interest would be served by enhancing wireless communications and emergency 91 1 capabilities, and WHEREAS, A surety in a form acceptable to the Finance Committee must be approved prior to release of building permits, and WHEREAS, Equipment cabinets are proposed to be contained within a fenced enclosure elevated within a drainage swale, and this does not meet the Chapter 36 requirement that equipment cabinets be enclosed in a structure with residential character, and WHEREAS, A landscape plan is required to be submitted, and said submittal has not been received at this time. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building. Site and Operation Plan submitted by WFI representing Telecorp Realty, Inc. for a stealth wireless communications facility on the WEPCo right-of-way located abutting at S79 W16464 Woods Road (Abutting Tax Key No. 2218.990.001). WEPCO RIGHT-OF-WAY PROPERTY (NW X OF SECTION 15 I ABUTTING THE e I I BE IT FURTHER RESOLVED, That Equipment cabinets shall be enclosed in a structure with residential character per Chapter 36 Wireless Facilities Sitinq Ordinance, and shall not be located within a drainage swale. BE IT FURTHER RESOLVED, That this approval is subject to receipt and approval of a surety by the Finance Committee prior to release of building permits. BE IT FURTHER RESOLVED, That this approval is subject to approval of a landscape plan by the Planning Staff prior to release of building permits. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspects of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping andlor asphalting. a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
