APPROVAL OF A TWO (2) LOT LAND DIVISION FOR THE COUNTER PROPERTY
LOCATED IN THE SW 'h OF SECTION 25 (TAX KEY NO. 2259.995 I LOOMIS DRIVE)
WHEREAS, On September 7,2001 a certified survey map was submitted by Donald
Counter for a two (2) lot land division of the Counter property located in the SW 'h of
Section 25, (Tax Key No. 2259.995 / Loomis Drive), and
WHEREAS, The Plan Commission approved a sketch land division by Resolution #PC
089-2001 on June 19,2001, and
WHEREAS, The proposed land division would create lots with a minimum area of 3.2
acres and an average minimum width of approximately 180 feet, and
WHEREAS, Said properties are zoned RSE, Suburban Estate District, for the northerly
400-feet abutting the Loomis Drive right-of-way, requiring a minimum lot size of 40,000
square feet and an average minimum width of 150 feet, and the remainder of the
property is zoned A, Agriculture District, requiring a minimum lot size of 2.75 acres and
an average minimum lot width of 300 feet, said parcels meet said minimum zoning
requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for
agriculture and open lands, including rural density residential development, and this
proposal is within this goal, and
e
WHEREAS, Said parcels will be serviced by municipal sanitary sewer and private water,
and
WHEREAS, A 60-foot wide strip of land is illustrated on the parent parcel, which may
provide access if the remaining lands were to develop in the future, and
WHEREAS, Wetlands exist on the parent property, and may be required to be
delineated if development is proposed on the parcel, and
WHEREAS, The property currently has approximately 3,800 SF of accessory structures,
and such structures are in compliance with the dimensional requirements of the zoning
ordinance.
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a Certified
Survey Map creating a two (2) lot land division of the Counter property in the SW 'A of
Section 25 subject to resolution of technical discrepancies as identified by the City
Planning Department and City Engineers, and payment of all applicable fees in Section
18.14(3) of the Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the Plan Commission waives the requirement for
wetland delineation on Parcel 2 until such time as further land division of Parcel 2 is
proposed.
BE IT FURTHER RESOLVED, That a digital *.DXF file, '.DGN file, or 'DWG file of this
final plat be submitted to the City prior to City signatures being placed upon the CSM (3-
1/2" diskette) and all information transmitted on the diskettes shall be tied to and
referenced to State Plane Coordinates NGVD 1929 or others approved by the City
Engineer
