RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT FOR THE
SETTLEMENT ON WOODS ROAD SUBDIVISION BY THE O'CONNOR
COMPANY LOCATED IN THE NE1/4 AND NW %OF SECTION 20
(TAX KEY NO 2237.998)
WHEREAS, On August 15, 2001 a preliminary plat was submitted by The
O'Connor Company for The Settlement on Woods Road on the Dorothy Benke
property located in the NE 1/4 and NW % of Section 20, and
WHEREAS, On August 28, 2001 revisions to the preliminary plat were received
in response to preliminary staff review comments, and
WHEREAS, Said plat consist of approximately 55.8 acres, and proposes 58
residential parcels, ranging from 18,000 square feet to 36,000 square feet in
size, and 9 outlots, and
WHEREAS, Said property is zoned A - Agricultural District, and is proposed to
be rezoned to RS-2 / OPD Suburban Residence District with Planned
Development Overlay District, and
WHEREAS, Said Preliminary Plat substantially conforms to that of the Plan
Commission's previously approved sketch, under Resolution #P.C. 052-2001,
and

WHEREAS, The 2010 Comprehensive Plan depicts this area for rural and
agricultural use, and the Plan Commission has approved in concept an
amendment to the Plan to depict medium density residential development, and
WHEREAS, Said parcels will be serviced by City sewer and water, and
WHEREAS, The 2010 Street System Plan depicts Woods Road to have an 80
foot wide ultimate right-of way, and the appropriate dedications are provided
adjacent to existing rights-of-way, and must be illustrated along the entire
northern plat boundary. and
WHEREAS, Public rights-of-way have been extended to the south and west plat
lines, and
WHEREAS, Wetlands and floodplains are present on the subject parcel, and
WHEREAS, The 2001-2005 Park and Open Space Plan does not identify any
land acquisitions in the area, and
0 WHEREAS, The DRAFT Conservation Plan identifies portions of the property as
having high ecological significance and recommends public acquisition of said
areas.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends
approval to the Common Council of a 55.8 acre, 58 lot, 9 outlot, preliminary plat
for The Settlement on Woods Road Subdivision by The O'Connor Company
located on the Dorothy Benke property in the NE114 and NW X of Section 20
and will be receptive to the submittal of a final plat, subject to resolution of
technical discrepancies as identified by the City Planning Department and City
Engineers, and payment of all applicable fees in Section 18.14 of the Land
Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That concurrent with final plat review, the Plan
Commission shall be receptive to a rezoning petition to the RS-2 / OPD
Suburban Residence District with Planned Development District Overlay.
BE IT FURTHER RESOLVED, That concurrent with final plat review, the Plan
Commission shall be receptive to a petition to amend the 2010 Comprehensive
Plan to depict medium density residential development on the subject parcel.
BE IT FURTHER RESOLVED. That the Plan Commission recommends the
public acquisition of Outlot 2 for conservation purposes.
BE IT FURTHER RESOLVED, That the Plan Commission recommends private
ownership, by an incorporated home owners association, for all other outlots.
BE IT FURTHER RESOLVED, That the Plan Commission recommends the
development of conservation management plans for Outlots 1, 5, 7, and 9
concurrent with final plat submittal.
BE IT FURTHER RESOLVED, That all wetlands and floodplains are to be
properly identified on the face of the final plat, and the final plat shall include text
describing wetland regulations.
BE IT FURTHER RESOLVED, That Woods Road right-of-way shall be reserved
along the northerly 40 feet of Outlots 7 and 9.
BE IT FURTHER RESOLVED, That temporary cul-de-sac easements shall be
illustrated on the final plat at the westerly termination of Timberbrook Drive.
BE IT FURTHER RESOLVED, That right-of-way for a permanent cul-de-sac
shall be dedicated at the southerly termination of Windover Court, and a 60 foot
wide right-of-way shall be dedicated to the southerly plat line.
BE IT FURTHER RESOLVED, That the Windover Drive right-of-way located
north of Deerfield Drive shall be labeled "temporary roadway to be vacated upon
the extension of Deerfield Drive to Plum Creek Blvd"
BE IT FURTHER RESOLVED, That the right-of-way of Timberbrook Drive shall
be renamed on the final plat to avoid duplication of similar street names within
the community.
BE IT FURTHER RESOLVED, That the right-of-way of Settlement Court located
north of Timberbrook Drive shall be named "Settlement Drive"
BE IT FURTHER RESOLVED, That the final plat shall include easements as
required by the utilities of jurisdiction, and shall include 5 foot wide street tree
easements on both sides of all rights-of-way.
