PCR2001131RESOLUTION #P.C. 131-2001 APPROVAL OF AN ACCESSORY STRUCTURE FOR THE CASE PROPERTY LOCATED AT S72 W17385 SCHUBRING DRIVE (TAX KEY NO. 2193.989.004) WHEREAS, On August 21, 2001 a site plan and construction information was submitted by W17385 Schubring Drive, and Charles Case to construct a 480 square foot accessory structure at the property located at S72 WHEREAS, The property is zoned RS-3/0LS. Suburban Residence District as modified by the Lakeshore Overlay, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.l, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable first floor area and said area contains 1,346 square feet which would allow 808 square feet of total square footage of accessory buildings, and WHEREAS, Two outbuildings currently exist on the parcel totaling 240 square feet, and said structures will be razed, and WHEREAS, The location of the proposed structure meets the required setback and offsets, the ultimate height is limited to 15 feet, the architectural appearance would be compatible with the applicant's surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities, and 0 and will match the existing residence. WHEREAS, The structure will be constructed with white vinyl siding and a white shingled roof, THEREFORE BE IT RESOLVED, That the Plan Commission approves of a structure not exceeding 480 square feet for the Case property at S72 W17385 Schubring Drive in accordance to Section 4.05 (1) B and 6.1 1 (2). BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action. or both.
