PCR2001120ARESOLUTION #P.C.120a-2001 I 6 APPROVAL OF A SKETCH LAND DIVISION FOR THE HElN PROPERTY LOCATED IN THE NE '/.OF SECTION 12 (TAX KEY NO. 2205.999.030 AND 2205.982 / TESS CORNERS DRIVE) WHEREAS, A sketch land division was submitted by David Hein for a one (1) lot land division of the Hein property located in the NE of Section 12. (Tax Key No. 2205.999.030 and 2205.982 I Tess Corners Drive), and WHEREAS, Said property is zoned RS-2. Suburban Residence District, requiring a minimum lot size of 20,000 square feet and an average minimum width of 110 feet, and the proposed parcel meets these requirements, and WHEREAS, The petitioner proposes to access the parcel through a aBfeetaft46O-foot- wide street reservation connecting to Tess Corners Drive, and- ,. v, and WHEREAS. The 2010 Comprehensive Plan depicts this area as being set aside for medium density residential development, and this proposal is within this goal, and WHEREAS, The 2001 - 2005 Park and Open Space Plan indicates that a community park is to be located within the vicinity of the proposed land division, and this petition has been referred to the Park and Recreation Board for their review, and I WHEREAS, Said parcels will not be serviced by City water, and WHEREAS, The parcel is located within the sewer service area, and this petition has been referred to the Public Utilities Committee for their review, and ai& .. WHEREAS, Double the lot area and width is required for the parcel to be served by a private sanitary system, and if such a system is approved the submittal &e&neL must be amended to meet these 1 requirements, and WHEREAS, The 2010 Street System Plan depicts Tess Corners Drive to have a 100-foot ultimate right of way width, and the right-of-way has not been dedicated to its full width, and water mark must be illustrated, and WHEREAS. The proposed parcel contains a navigable waterway and the meander line and ordinary high- WHEREAS, The navigable stream setback and shoreland jurisdictional limits are to be measured from the ordinary high-water mark, and WHEREAS, it is the opinion of the Attorney General that "a river. stream, or creek that crosses a parcel legally divides said parcel as a highway would," and said division must be properly illustrated on the Final Certified Survey Map, and WHEREAS, Section 18.40(l)(f) requires public access to navigable streams, and said access must be at least 100' in width and front a public street, highway, parkway, or other public way, and the Building and Engineering Director has provided written documentation that the land division complies with Wisconsin Statutes in this regard, and e e WHEREAS, Section 18.25(1)(c) dictates that all lots greater than one acre in size must have a minimum 0 of 40,000 SF of land at or above the 100-year flood elevation, and I THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map being submitted for a one (1) lot land division of the Hein property located in the NE %of Section 12. BE IT FURTHER RESOLVED, That the Public Utilities Committee shall make a determination regarding sewer service to the property. width required in the RS-2 District in order to be served by a private sanitary system. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and indication of the current intent of the Plan Commission; Final submittals are subject to future review and approval of final plans is not guaranteed by this action of the Pian Commission.
