PCR2001076APPROVAL OF AN ACCESSORY STRUCTURE FOR RESOLUTION #P.C. 076-2001 THE CEBALLOS PROPERTY LOCATED AT S73 W14270 WOODS ROAD WHEREAS, A site plan and construction information was submitted by Luis and Amy Ceballos to construct a 210 square foot lean-to addition to the accessory structure on their property located at S73 W14270 Woods Road on May 29.2001, and WHEREAS, The property is zoned Rs-3. Suburban Residence District, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.l. and WHEREAS, The total square footage for accessory structures is limited to 1.0% of the total lot area and contains 3.03 acres which would allow 1,320 square feet of total square footage of accessory buildings, and WHEREAS, The existing structure on the parcel totals 910 square feet, and WHEREAS, The petitioners received approval from the Plan Commission in Resolution #PC 188- 2000 to construct an addition to the existing structure not to exceed 410 square feet, and WHEREAS, The proposed lean-to addition would bring the total area of the accessory structure to 1,530 square feet, and the Plan Commission may allow exceptions to the 1-percent requirement in "predominantly undeveloped areas." and WHEREAS, The proposed location of the structure maintains all necessary offsets and setbacks, the ultimate height is limited to 25 feet so long as a minimum of 2.75 acres is maintained, the materials submitted do not propose the use of this nor any other structure on the property for architectural appearance would be compatible with the applicant's surrounding area, and the business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission finds that the parcel meets the criteria for a predominantly undeveloped area to allow for an exception to the 1-percent requirement for accessory structures and approves of a compatible sized, open air, lean-to structure not exceeding 210 square feet for the Ceballos property located at S73 W14270 Woods road in accordance to Section 4.05 (1) B and 6.11 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. THEREFORE BE IT RESOLVED, That the petitioner shall submit a revised site plan and building elevations which clearly illustrates the proposed addition in order to receive building permits. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
