PCR2001059RESOLUTION #P.C. 059-2001 APPROVAL OF A RETAINING WALL AND FENCE HEIGHT EXCEPTION FOR THE CORRAO PROPERTY LOCATED AT S67 W19043 TANS DRIVE (TAX KEY NO. 2180.054) WHEREAS, On April 25, 2001 a site plan and construction information was submitted by W19043 Tans Drive, and Salvatore Corrao to construct a retaining wall and fence at the properly located at S67 WHEREAS, The property is zoned RS-2, Suburban Residence District, and where said structures are a permitted accessory use per Section 4.05 (2) D.. and WHEREAS, The height of a retaining wall is limited to 6-feet, and the proposed retaining wall is 5-feet in height, and WHEREAS, The height of a fence is limited to 6-feet in height within the required 15-foot offsets, and the proposed fence is 6-feet in height, and WHEREAS, The fence is proposed to be located directly atop the retaining wall, effectively making the total height of the structure 11-feet from grade, and the Zoning Code requires written consent of the adjoining property owners to the south and east and Plan Commission approval. e THEREFORE BE IT RESOLVED, That the Plan Commission approves of a retaining wall and fence located within the required offset for the Corrao property at S67 W19043 Tans Drive in accordance to Section 4.05 (2) D.. subject to written consent of the adjoining property owners to the south and east. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
