APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR DUPLEX
(PARENT PARCEL TAX KEY NO. 2228.998 / NW 'A OF SECTION 16)
0 STRUCTURES ON THE PEGARL, LLP PROPERTY LOCATED ON WOODS ROAD
WHEREAS, On April 20,2001 plans were submitted by Earl Meinen for approval of a
building site and operation plan for six (6) duplex structures on the Pegarl, LLP property
located on Woods Road (Parent Parcel Tax Key No. 2228.998), and
WHEREAS, On Mav 25,2001 said plans were revised as requested bv Plan
Commission at their May 1, 2001 meetinq, and
WHEREAS, On June 5", 2001 said plans were further revised to address FEMA
standards. and
WHEREAS, Said property is zoned RSNOPD, Attached Single Family Residence with
Planned Development Overlay District, and the proposed duplex use is permitted by
right, and
WHEREAS, Each parcel depicts one (1) access drive on Woods Road, and
WHEREAS, The proposed offsets are
way,"%&&- and vary from side lot lines as illustrated in the June 5, 2001 submittal,
and 10-feet from wetlands, and
WHEREAS, Landscaping plans ps illustrating
foundation and perimeter plantings awwptd-have been submitted for review, and-
meet the minimum standards of the Muskeqo Desiqn Guide, and
WHEREAS, All street trees must be located outside of sanitary force main easements,
and -
WHEREAS, Revised buildinq elevations have been provided which depict unique
architectural treatment of each unit, and
WHEREAS, The Muskego General Design Guide states "All multiple family buildings
shall have a minimum exterior finish of 50% brick. Two family structures shall be
reviewed on an individual basis to allow for greater flexibility in design: 50% brick
pefemt- varv in the amount of brick on only the front elevation, and
0 requirement may be relaxed," and the elevation plans
WHEREAS, The parcels are significantly affected by wetlands and the 100-year flood
boundary, and partial exposures have been illustrated on the elevation plans, and the
site plans submitted -indicate elevations, required setback and offsets, and I 0 grades above the floodplain, and
WHEREAS, Calculations indicating the square footage of each parcel on the site, the
square footage devoted to building space, paving; landscaping and open space is
eqw&t&shave been submitted, and
WHEREAS, Said parcels will be serviced by public sewer and water
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a building site
and operation plan for six (6) duplex structures on the Pegarl, LLP property located on
Woods Road (Parent Parcel Tax Key No. 2228.998).
BE IT FURTHER RESOLVED, That side yard offsets are approved as illustrated on the
June 5,2001 submittal.
BE IT FURTHER RESOLVED, That a 10 foot maintenance easement must be recorded
to address the zero lit line qranted to Buildinq 5.
BE IT FURTHER RESOLVED, That this approval is subiect to Public Utilities Committee
approval of Buildina 6 encroachment into the sanitaw force main easement.
BE IT FURTHER RESOLVED, That additional landscape screeninq shall be installed
landscapinq shall be approve by the Planninq Department prior to release of buildinq
permits.
BE IT FURTHER RESOLVED, Buildinq 1 shall have face brick wainscotinq constructed
on the west elevation.
BE IT FURTHER RESOLVED, Buildinq 5 shall have face brick wainscotinq constructed
on the east elevation.
BE IT FURTHER RESOLVED, Buildinq 6 shall have face brick wainscotinq installed on
the west elevation and south elevation.
BE IT FURTHER RESOLVED, That this approval is subiect to the Citv Enqineer's
approval of revisions to the qradinq plan.
BE IT FURTHER RESOLVED. That revised landscape plans are required to be
submitted for review and approval by the Planninq Department prior to permit issuance.
BE IT FURTHER RESOLVED, That street vard setbacks may be reduced to 21 feet as
may be required in coniunction with qradinq plan approval and FEMA floodplain
standards.

BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Buildinq
Department and that all aspect of this plan as they relate to landscape areas and
drainaqe shall be maintained in perpetuity unless otherwise authorized by the Plan
Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscapinq andlor asphaltinq. a bond, letter of credit or cashiers check equal to twice
the value of said costs must be submitted to the Planninq Department.
BE IT FURTHER RESOLVED, That failure to complv with the approval contained in this
resolution shall result in the imposition of fines of $1 00 per day, the initiation of legal
action. or both.
