PROPERTY LOCATED IN THE NE ?4 AND NW '/4 OF SECTION 20
(TAX KEY NO. 2237.998)
WHEREAS, A sketch for a preliminary plat was submitted by Kalvin Klimeck and
Sean O'Connor for a subdivision of the Benke property located in the NE % and
NW 1/4 of Section 20, and
WHEREAS, At the request of the Plan Commission, an additional four
development sketches were submitted by Kalvin Klimeck and Sean O'Connor
representinq differinq development densities and parcel sizes, and
WHEREAS, Said plat consist of 58.85 acres, 7, and
WHEREAS, Said property is zoned A - Agricultural District, requiring a minimum
lot size of 2.75 acres, and a rezoning would be required in order for the proposal
to proceed.
WHEREAS, The 2010 Comprehensive Plan depicts this area for agricultural and
open space use, and a Plan amendment would be required in order for the
proposal to proceed, and
WHEREAS, Said parcels are proposed to be sewiced by City sewer and water,
and
WHEREAS, Woods Road is depicted to be an 80 foot ultimate right-of-way
abutting the plat, and
WHEREAS, Wetlands are present on the subject property, and
WHEREAS, The proposed subdivision abuts Muskego Drainage Canal #1, a
navigable waterway, and includes unmapped floodplains tributary to Big
Muskego Lake, and
WHEREAS, The DRAFT Conservation Plan identified certain portions of the
property as recommended for permanent open space acquisition.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a
55.85 acre; P&bt+.ketch preliminary plat for the Benke property, located in the I
NE l/i and NW '/4 of Section 20 and will be receptive to the submittal of a
preliminary plat.

BE IT FURTHER RESOLVED, That the Plan Commission is receDtive to an
amendment to the 2010 Comprehensive Plan to depict the subject property for
low density residential development at densities not to exceed-M1.1dwelling * units per acre.
BE IT FURTHER RESOLVED, That the Plan Commission is receptive to a
zoning map amendment to depict the subject property for RS"RS-21 OPD
Suburban Residence District with Planned Development Overlay District, subjecl
to deed restrictions which limit development of the parcel to a maximum of &EL-
lJdwelling units per acre, and with the majority of parcels beinq 18.000 square
feet in area and 100 feet in averaqe width in order to maximize the amount of
open space within the development.
BE IT FURTHER RESOLVED, That the development shall qive consideration to
the recommendations of the DRAFT Conservation Plan, as they relate to
preservation and acquisition of lands identified therein.
BE IT FURTHER RESOLVED, That all wetlands must be depicted on the face of
the preliminary and final plats, and to the extent practical, all wetlands which are
not on lands conveyed to the public shall be placed within outlots to be owned
and maintained by an incorporated Home Owners Association.
BE IT FURTHER RESOLVED, That all floodplains and lands less than two feet
above floodplain levels must be depicted on the face of the preliminary and final
plats, and to the extent practical, all floodplain areas which are not on lands
conveyed to the public shall be placed within outlots to be owned and maintained
by an incorporated Home Owners Association.
BE IT FURTHER RESOLVED, That stormwater management improvements
shall be placed within outlots to be owned and maintained by an incorporated
Home Owners Association.
BE IT FURTHER RESOLVED, That all lands within 20 feet of the ordinary high
water mark of Muskego Drainage Canal #1 which are not on lands conveved to
the public shall be placed within outlots to be owned and maintained by an
incorporated Home Owners Association.
BE IT FURTHER RESOLVED, That all Woods Road right-of-way dedications
required pursuant to the 2010 Street System Plan must be illustrated on the face
of the preliminary and final plat.
BE IT FURTHER RESOLVED, That the western street connection to Woods
Road shall be labeled “temporary” on the face of the preliminary and final plat
and shall be ultimately planned to be a cul-de-sac, with the termination of said
connection made in conjunction with the development of the Frank DeAngelis
property, identified as 587 W19543 Woods Road / Tax Key No. 2237.992.
BE IT FURTHER RESOLVED, that this approval is granted in concept only and
final action is only an indication of the current intent of the Plan Commission;
Final submittals are subjeci to future review and consideration by the Plan
Commission, municipal committees of jurisdiction, and other agencies, and
approval of final plans is not guaranteed by this action of the Plan Commission,
