RECOMMENDATION OF APPROVAL TO REZONE PROPERTY TO RS-3
SUBURBAN RESIDENCE DISTRICT AND AMEND THE 2010
COMPREHENSIVE PLAN, FOR PROPERTIES LOCATED IN THE NE %AND
SE X OF SECTION 24 AND NE % OF SECTION 25
(NORTH CAPE ROAD, RYAN RD TO BOXHORN DR)
WHEREAS, A petition for rezoning was submitted by the Planning Department to
rezone properties in the vicinity of North Cape Road, generally between Ryan
Road and Boxhorn Drive, and
WHEREAS, The area is subject to sanitary sewer installation, and the City of
Muskego has a standing policy to rezoning properties to sewered districts when
such service becomes available, and
WHEREAS, The affected parcels, their current and proposed zoning, are as

0 WHEREAS, A Public Hearing for the rezoning has been scheduled before the
Common Council on March 27, 2001, and
WHEREAS, The 2010 Comprehensive Plan anticipates lands on the east side of
North Cape Road as being set aside for medium density residential uses
consistent with the RS-2 and RS-3 Districts, and the proposed rezoning is
consistent with the Plan. and
WHEREAS, The 2010 Comprehensive Plan anticipates lands on the west side
of North Cape Road as being set aside for low density residential development
consistent with the R-1 and R-2 unsewered districts or RSE sewered district, and
the Plan is inconsistent due to parcel non-conformities that would result from the
application of said zoning districts, and
WHEREAS, The Plan Commission proposed to amend the 201 0 Comprehensive
Plan to eliminate these nonconformities, by reclassifying the subject parcels to be
planned for medium density residential uses consistent with the RS-2 and RS-3
Districts.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby
recommend approval to the Common Council for the rezoning of lands as
described in the table above, subject to the installation and availability of sanitary
sewers to serve said parcels.
BE IT FURTHER RESOLVED, That the Plan Commission hereby amends the
2010 Comprehensive Plan to reflect medium density residential use, consistent
with the RS-2 and RS-3 Districts, for the parcels described in the table above.
