APPROVAL OF A HEIGHT MODIFICATION IN ACCORDANCE WITH SECTION
175.03 (2) (D) OF THE ZONING ORDINANCE, FOR A SINGLE FAMILY
RESIDENCE ON THE KASHIAN PROPERTY LOCATED IN THE SE X OF
SECTION 29 (TAX KEY NO. 2276.999 I DE BACK DRIVE)

WHEREAS, On March 7, 2001 an application for a height exception was
submitted by Russ Kashian for the purpose of constructing a single family home
on a property located in the SE X of Section 29 (Tax Key No. 2276.999 I De
Back Drive), and
WHEREAS, the property is zoned R-I Country Home District and single family
residences are permitted to be 30 feet in height, as measured from grade to the
midpoint of a gabled roof, and
WHEREAS, The proposed residence is approximately 34.5 feet measured from
grade to the midpoint of the highest gabled roof, and
WHEREAS, The no habitable floors are located above the 30 feet, and all parts
of the structure located above 30 feet are intended for architectural
ornamentation, and include an observation platform designed to meet the egress
requirements of the Uniform Dwelling Code, and
WHEREAS, Section 175.03 (2) (D) of the Zoning Ordinance allows the Plan
Commission the grant height exceptions.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby
approve a height exception for the purpose of constructing a single family
residence, as submitted by Russ Kashian for property located in the SE X of
Section 29 (Tax Key No. 2276.999 I De Back Drive)
