APPROVAL OF AN ACCESSORY STRUCTURE FOR THE SORENSON PROPERTY
LOCATED AT 582 W12823 ACKER DRIVE (TAX KEY NO. 2209.967)

WHEREAS, On January 10, 2001 a site plan and construction information was
submitted by David Sorenson to construct a 288 square foot accessory structure at the
property located at S82 W12823 Acker Drive, and
WHEREAS, The property is zoned RSE. Suburban Estate District, and where said
structure is a permitted accessory use and subject to Plan Commission review per
Section 4.05 (2) C.l, and
WHEREAS, The total square footage for accessory structures is limited to 60% of livable
area of the first floor of the residence and contains approximately 1 .825 which would
allow 1,095 square feet of total square footage of accessory buildings, and
WHEREAS, One 90 square foot shed currently exists on the parcel. and
WHEREAS, The location of the structure meets the required setback, and the required
offset is 25 feet, the ultimate height is limited to 15 feet, the architectural appearance
would be compatible with the applicant's surrounding area, and the materials submitted
do not propose the use of this nor any other structure on the property for business
related activities, and

WHEREAS, The structure will be constructed with asphalt shingles and T-I 11 siding
with pine trim, and the materials and colors will match the existing residence.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible
size structure not exceeding 288 square feet for the Sorenson property at S82 W12823
Acker Drive in accordance to Section 4.05 (1) B and 6.1 1 (2).
BE IT FURTHER RESOLVED, That a plat of survey illustrating a 25 side offset for the
proposed structure must be submitted prior to the release of a building permit.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per
violation, the initiation of legal action, or both.
