PCR2000220RESOLUTION #P.C. 220-2000 RECOMMENDATION TO COMMON COUNCIL TO REZONE PROPERTY FROM EA IOOS EXCLUSIVE AGRICULTURE DISTRICT WITH OFFICE AND SPECIAL SERVICE OVERLAY DISTRICT TO A - AGRICULTURE DISTRICT, AND APPROVAL OF A CERTIFIED SURVEY MAP FOR A TWO (2) LOT LAND DIVISION FOR THE KAEBISCH PROPERTY LOCATED IN THE NW X OF SECTION 29 (RACINE AVENUE /TAX KEY NO. 2274.997.001) WHEREAS, A certified survey map was submitted by Laurel Kaebisch for a two (2) lot land division of the Kaebisch property loca!ed in the NW Yi of Section 29 (Racine Avenue I Tax Key No. 2274.997.001), and WHEREAS, Said Certified Survoy Map substantially conforms to that of the Plan Commission's previously approved sketch review, under Resolution #P.C. 220-2000, and WHEREAS, Said property is prcposed to be rezoned from EA I 00s Exclusive Agriculture District with Office and Special Service Overlay District to A - Agriculture District, requiring a minimum lot size of 2.75 acres and an average minimum width of 3013 feet, and said lots appear to meet said minimum zoning requirements, and WHEREAS, The adopted Comprehensive Plan depicts this area for rural and agricultural use, and the proposal is consistent with the Plan, and WHEREAS, Parcel 1 is proposed to remain in agricult?rral use at this time, and therefore Soil tests for private on-site sewer have not been provided, and wetlands have not been delineated, and WHEREAS, Parcel 2 will be serviced by private on-site sewer and water facilities, and WHEREAS, A grading plarl has not been cubmirted for Parcel 2, and WHEREAS, Access to Racine Avenue is subject to tb.e approval of the Waukesha County Department of Transportaticrl. THEREFORE BE IT RESOLVED, That tne Plan Commission recommends approval to the Common Council of a Certified Survey Map fcr a two (2) lot land division of the Kaebisch property located in the NW % of Section 29 subject to resolution of technical discrepancies as identified by the City Planping Department act! City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, That the Plan Commission approval of the Certified Survey Map is conditioned upon the receipt of access pernits from the Waukesha County Department of Transportation. BE IT FURTHER RESOLVED, That no hildiq permits shall be issued for Parcel 1 until such time that soil tests have bran received by the Plannina Department which indicate that the parcel may be suited for an on site sanitary system, and until such time that any wetlands which may be located on the property are delineated and the Planning Department is in receipt of same. ~ @ BE IT FURTHER RESOLVED, That a grading plan shall be submitted to and approved by the City Engineer prior to the issuance of building permits for Parcel 2. BE IT FURTHER RESOLVED, That the Plan Commission recommends the rezoning of the subject property from EA I 00s Exclusive Agriculture District with Office and Special Service Overlay District to A - Agriculture District, BE IT FURTHER RESOLVED, That a disital ".DXF file, DGN file, 01' *.DWG file of this Certified Survey Map be submitted io the City priw to City signatures being placed upon the CSM (3-112' diskette) and all information transmitted on the diskettes sha!l be tied to and referenced to State Plane Coordinates NGVD 1929 or others approved by the City Engineer Plan Commission City Gf Muskego Adopted: December 19, 2000 Defeated: Deferred: Introduced: December 19, 2000 AlTEST.
