PCR20002170 DEFEATED RESOLUTION #P.C. 217-2000 APPROVAL OF A BUILDING SITE AND OPERATION PLAN AND CONDITIONAL USE GRANT FOR OPERATION OF A COMMERCIAL KENNEL UNION CHURCH ROAD (PART OF TAX KEY 2296.998) WHEREAS, On December 8,2000 plans were submitted by Thomas Waite for a building, site and operation plan and Conditional Use Grant for a commercial dog kennel located on the property located in the SE 1/4 of Section 34 (Union Church Road / Part of Tax Key 2296.998), and WHEREAS, Said property is currently zoned EA-Exclusive Agriculture District, and said use is permitted with a Conditional Use Grant in the A-Agriculture District, as specified by the zoning district requirements, and WHEREAS, A Public Hearing to rezone the property has been scheduled before the Common Council on January 9,2001, and WHEREAS, The petitioner proposes to accommodate a maximum of 50 dogs for boarding and training, and WHEREAS, The petitioner proposes to construct two buildings, one approximately 4,400 square feet to house the dogs, and the other approximately 1,748 square feet for maintenance equipment, and agricultural buildings are exempt from the architectural review requirements of the Plan Commission, and WHEREAS, A privacy fence is proposed along the southern property line and surrounding the kennel and dog runs, and WHEREAS, The hours of operation are proposed seven days a week, 7AM to 7PM, and WHEREAS, An asphalt drive is proposed along the west property line and along the kennel and equipment structures, and WHEREAS, The property will be served by private water and sanitary systems, and WHEREAS, Exterior lighting is proposed for the kennel and equipment structures, and photometric plans have not been provided, and e WHEREAS, That a deed restriction has been placed on the property prohibiting further land division while the Condition Use Grant for the commercial kennel is in effect. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the building, site and operation plan and Conditional Use Grant submitted for a commercial dog kennel located in the SE 1/4 of Section 34. BE IT FURTHER RESOLVED, That photometric plans are required to be approved by the City Engineer prior to issuance of building permits. BE IT FURTHER RESOLVED, That an annual review before the Plan Commission is required as a condition of approval. BE IT FURTHER RESOLVED, That at the call of the Plan Commission Chairman, the operations subject to this conditional use grant may be subject to further review by the Plan Commission, and any future operations which are deemed to be inconsistent with this approving resolution may be subject to further conditions by the Plan Commission.
