AMENDMENT TO THE BUILDING SITE AND OPERATION PLAN
FOR ARBY’S RESTAURANT FOR COLLEY & ASSOCIATES, LLC.
AT THE PROPERTY LOCATED AT S73 W16770 JANESVILLE ROAD
WHEREAS, Plans were submitted by Carisch Inc. to amend the building, site and
operation plan for an Arby’s restaurant located S73 W16770 Janesville Road on
September 30,2000, and
WHEREAS, Said property is currently zoned B4 Highway Business District, and
OPD Planned Development District and use is a permitted use by right, and
WHEREAS, BSO plan approval was previously granted on April 18,2000 by
Resolution #PC 80-2000, and
WHEREAS, Petitioner proposes to utilize the existing planters on the east and
west sides of the structure, and
WHEREAS, The petitioner proposes to utilize the existing windows on the east
and west faced of the structure, and this does not conform to the previously
approved plans, and
WHEREAS, Said windows may be utilized provided that they include mullions to
continue the architectural rhythm established by the window patterns approved
by Resolution #PC 80-2000, and
WHEREAS, Petitioner proposed to replace three existing pole mounted exterior
light fixtures with poles and luminaires approved for use by the Downtown Desiqn
Guide, and
WHEREAS, Said poles and luminaires are permitted provided that photometric
plans are provided which establish an absence of light trespass at property lines.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the
amended building, site and operation plan submitted by Carisch, Inc. for an
Arby’s Restaurant at S73 W16770 Janesville Road.
BE IT FURTHER RESOLVED, That the windows required on the east and west
facade shall incorporate mullions or vertical split pane as previously approved in
Resolution #PC 80-2000.
c BE IT FURTHER RESOLVED, That photometric plans for the new exterior
lighting shall be approved by the City's consulting engineers and Planning
Director prior to installation of new poles and luminaires.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the
Building Department and that all aspects of this plan as they relate to landscape
areas and drainage shall be maintained in perpetuity unless otherwise authorized
by the Plan Commission.
BE IT FURTHER RESOLVED, That if permanent occupancy is requested prior to
the installation of lighting a bond or cashiers check equal to twice the value of
said costs must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the
completion of the installation of the required window mullions or vertical split
pane a cash bond or cashiers check equal to twice the value of said costs must
be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained
in this resolution shall result in the imposition of fines of $100 per day, the
initiation of legal action, or both.
