APPROVAL OF A 30 X 48 ACCESSORY STRUCTURE FOR
THE CHEREK PROPERTY LOCATED AT S75 W17960 JANESVILLE ROAD
WHEREAS, A site plan and construction information was submitted by RuSSO
Construction to construct a 30 x 48 (1,440 square foot) accessory structure at
the Cherek property located at S75 W17960 Janesville Road on September 22,
2000, and
WHEREAS, The property is zoned Rs-~IB-~IOLSIOPD, and where said StWCtUre
is a permitted accessory use and subject to Plan Commission review per Section
4.05 (2) C.l, and
WHEREAS, The total square footage for accessory structures is limited to 60%
of the total first floor primary habitable area and contains 2,556 square feet which
would allow 1,533 square feet of total square footage of accessory buildings, and
WHEREAS, No outbuildings exist on the parcel, and
WHEREAS, The location of the structure must maintain 6.7' side offsets, the
architectural appearance would be compatible with the applicant's surrounding
area, and the materials submitted do not propose the use of this nor any other
structure on the property for business related activities, and
WHEREAS, The ultimate height of the proposed structure is limited to 15 feet as
specified by 17:2.02(8) of the zoning code.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a
compatible size structure not exceeding 1,400 square feet for the Cherek
property at S75 W17960 Janesville Road in accordance to Section 4.05 (1) B
and 6.1 1 (2) and that subject accessory structure not be used for the operation of
a business nor the storage of business related material or equipment.
BE IT FURTHER RESOLVED, That the proposed structure shall comply with the
district height and location requirements as specified in the zoning code.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this
resolution and the approved site plans shall result in the issuance of fines of
$100 per day per violation, the initiation of legal action, or both.
