PCR2000172ADOPTED RESOLUTION #P.C. 172-2000 APPROVAL OF A 421 SQUARE FOOT ACCESSORY STRUCTURE FOR THE CROSBY PROPERTY LOCATED AT S82 W13175 ACKER DRIVE (TAX KEY NO. 2209.995) WHEREAS, A site plan and construction information was submitted by Shirley Crosby to construct a 624 (24' x 26') square foot accessory structure at the property located at S82 W13175 Acker Drive on August 28,2000, and WHEREAS, The property is zoned RSE, Suburban Estate District, where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.1, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable first floor area and the property is allowed 581 square feet of total square footage of accessory buildings, and a 160 SF accessory structure currently exists on the property, and the proposed structure is to be constructed with lap siding and an asphalt shingled roof to match the existing residence, and WHEREAS, Accessory structures are limited to 15' in overall height in the RSE District, and the proposed structure meets this requirement, and 0 a WHEREAS, The location of the structure maintains all necessary offsets and setbacks, the architectural appearance would be compatible with the applica'nt's surrounding area, and the petitioners do not propose the use of this nor any other structure on the property for business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an accessory structure not exceeding 421 square feet for the Crosby property at S82 W13175 Acker Drive in accordance to Section 4.05 (1) B and 6.11 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
