PCR2000165AMENDED AND APPROVED RESOLUTION #P.C.165-2000 APPROVAL OF A BUILDING SITE AND OPERATION PIAN AND CONDITIONAL USE GRANT FOR THE PURPOSES OF SCREEN PROCESSING AND SALE OF EXCESS TOPSOIL FOR THE QUIETWOOD CREEK, LLC PROPERTY LOCATED IN THE SE 1/4 OF SECTION 3 AND THE NE 114 OF SECTION 10 (TAX KEY 2197.999) WHEREAS, On July 20, 2000 plans were submitted by Quietwood Creek, LLC for a building, site and operation plan and conditional use grant for the purposes of screen processing and sale of excess topsoil associated with the Quietwood Creek Subdivision property located in the SE 1/4 of Section 3 and the NE 114 of Section 10, and WHEREAS, Said plans indicate the location of stockpile to contain approximately 22,000 cubic yards of topsoil from the Quietwood Creek Subdivision, and WHEREAS, Said property is currently zoned RS-2 Suburban Residence District, and said use is permitted by Conditional Use Grant, and WHEREAS, A public hearing was held on August 15, 2000 before the Plan Commission regarding this issue, and WHEREAS, Vehicular access will be from Janesville Road and will utilize existing approved access points, and WHEREAS, A tracking pad will be required for all vehicular access, and WHEREAS, The hours of operation are proposed to be 7AM to 5PM Monday through Friday and 7AM to 2PM on Saturday, and WHEREAS, The petitioner has requested that this condition use expire in December of 2001 THEREFORE BE IT RESOLVED, That the Plan Commission approves of a building, site and operation plan and conditional use grant for the purposes of screen processing and sale of excess topsoil associated with the Quietwood Creek Subdivision property located in the SE 1 /4 of Section 3 and the NE 1/4 of Section 10. BE IT FURTHER RESOLVED, That the Saturday hours of operation be from 8AM to 2PM as directed by Municipal Code. BE IT FURTHER RESOLVED, that the Conditional Use Grant shall expire on December 31,2000. BE IT FURTHER RESOLVED, That a dust management plan for the entire Quietwood 6 Creek development be provided to the City Engineer for review and approval, which delineates how dust from the stockpile and entire site will be contained and minimized, and the plan must indicate how and when clean-up will occur on Janesville Road.
