APPROVAL OF A TWO (2) LOT CERTIFIED SURVEY MAP FOR THE LOEBEL PROPERTY
LOCATED IN THE SW % OF SECTION 21 (TAX KEY NO. 2241.997.001 / W181 S9134
PARKER DRIVE)
WHEREAS, A certified survey map was submitted by Gerald Loebel for a two (2) lot land
division of the Loebel property located in the SW % of Section 21, (Tax Key No.
2241.997.001 / W181 S9134 Parker Drive) on August 4,2000 and re-submitted on October
28.2000, and
WHEREAS, Said Certified Survey Map substantially conforms to that of the Plan Commission's
previously approved sketch review, under Resolution #P.C. 171 -98, on October 20, 1998, and
WHEREAS, The proposed land division would create two (2) lots, each with a minimum area
of 2.88 acres and an average minimum width of over 400 feet, and
WHEREAS, Said property is zoned A, Agricultural District, requiring a minimum lot size of 2.75
acres and an average minimum width of 300 feet, and both lots appear to meet said minimum
zoning requirements, and
WHEREAS, The adopted Comprehensive Plan depicts this area for Agricultural and Rural
development and this proposal is in compliance, and
WHEREAS, Said parcels will not be serviced by City sewer and will access water through
private wells, and
WHEREAS, An access easement is shown for adjoining property to the north, and
WHEREAS, Currently only one driveway access to the proposed parcels exist, and a cross-
access easement has not been illustrated on Parcel 1 to provide access to Parcel 2, and
WHEREAS, An existing garage structure will abut the proposed property line, and said
structure is proposed to be razed or removed within one vear of the recording of the
Certified Survey Map or sale of the property. whichever occurs firs- .. .

WHEREAS, The total square footage for accessory structures mav exceed 1 .O% of the total
lot area in predominantly undeveloped areas and prior
to Common Council approval the petitioner must ml meet the
code requirements.

THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the
Common Council of a Certified Survey Map for a two (2) lot land division of the Loebel
property located in the SW % of Section 21 subject to resolution of technical discrepancies as
identified by the City Planning Department and City Engineers, and payment of all applicable
fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, That a cross-access easement shall be illustrated on Parcel 1
to provide access to Parcel 2, or a new driveway shall be installed to serve Parcel 2 prior to
recording the Certified Survey Map.
BE IT FURTHER RESOLVEDl That the Plan Commission determines that the garage structure
on Parcel 1 which is abutting the proposed property line, shall be razed within one year of the
recording of this CSM, or the sale of the property, whichever occurs first, and this shall be
illustrated on the CSM.
BE IT FURTHER RESOLVED, That the location of the parcels is in a predominantlv
undeveloped area and the Plan Commission determines that Parcel 2 is permitted 8,896
SF of accessory structures./ ..
BE IT FURTHER RESOLVED, That a digital *.DXF file, *.DGN file, or *.DWG file of this
Certified Survey Map be submitted to the City prior to City signatures being placed upon the
CSM (3-1/2" diskette) and all information transmitted on the diskettes shall be tied to and
referenced to State Plane Coordinates NGVD 1929 or others approved by the City Engineer.
