PCR2000162RESOLUTION #P.C. 162-2000 APPROVAL OF A TWO (2) LOT SKETCH LAND DIVISION FOR THE NIEZGODA PROPERTY LOCATED IN THE SE % OF SECTION 10 (TAX KEY NO. 2200.989 I S77 W15784 WOODS ROAD) WHEREAS, On July 21, 2000 a sketch was submitted by KennethServi for a two (2) lot land division of the Niezgoda property located in the SE % of Section 10, (Tax Key No. 2200.989/ S77 W15784 Woods Road), and WHEREAS, The proposed land division would create lots with a minimum area of 20,000 square feet and an average minimum width of 220 feet, and WHEREAS, The land division ordinance requires new parcels to have a minimum depth of 100 feet, parcel 2 will have a minimum depth of 90.3 feet, and Section 18.24 of the land division ordinance permits the Plan Commission to grant waivers to this requirement, and WHEREAS, Said property is zoned RS-3, Suburban Residence District, requiring a minimum lot size of 15,000 square feet and an average minimum width of 100 feet, and parcel appears to meet said minimum zoning requirements for lot width, and WHEREAS, Legal access to parcel 2 is subject to the recording of the final plat of Quietwood Creek Subdivision, and WHEREAS, The 2010 Street System Map indicates that Woods Road is to have an ultimate width of 100 feet, and said sketch proposed to dedicated 50 feet measured from centerline, and WHEREAS, The adopted Comprehensive Plan depicts this area as being set aside for medium density residential development and this proposal is within this goal, and WHEREAS, The existing structure on parcel 1 is a legal non-conforming structure due to side yard offsets, and the land division is permissible because it will not increase the degree of structural non-conformity, and WHEREAS, Said parcels will be serviced by City sewer and water THEREFORE BE IT RESOLVED, That the Plan Commission approve of a sketch Certified Survey Map being submitted creating a two (2) lot land division of thdiezgoda property in the SE %of Section IO. BE IT FURTHER RESOLVED, That the Plan Commission approves of a lot depth of 90.3 feet for parcel 2. BE IT FURTHER RESOLVED, That the final CSM shall not be approved until the final plat e a of Quietwood Creek is recorded with the Waukesha County Register of Deeds. BE IT FURTHER RESOLVED, That this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
