PCR2000155RESOLUTION #P.C. 155-2000 APPROVAL OF A 1,600 SQUARE FOOT ACCESSORY STRUCTURE FOR THE 2255.981) STANISZEWSKI PROPERTY LOCATED AT S94 W13674 RYAN ROAD (TAX KEY NO WHEREAS, A site plan and construction information was submitted by Russ Chicks to construct a 1,600 square foot accessory structure at the property located at S94 W13674 Ryan Road on July 20,2000, and WHEREAS, The front 400 of the property is zonedRSE, Suburban Estate District, and the remainder is zoned R-2, Country Home District, where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.l, and WHEREAS, The structure is proposed to be located 400 from the Ryan Road right-of-way, in the R-2 Country Home District, and WHEREAS, The total square footage for accessory structures is limited to 1 % of the total land area and the property is allowed 2,178 square feet of total square footage of accessory buildings, and a 480 SF detached garage structure currently exists on the property, andaid structure is proposed to be constructed with light gray steel siding and an asphalt shingled roof with 2 eaves. and 0 WHEREAS, Accessory structures are limited to 15' in overall height in the R-2 District, and the structure is proposed to be 20 in height, and WHEREAS, The location of the structure maintains all necessary offsets and setbacks, the architectural appearance would be compatible with the applicant's surrounding area, and the petitioners do not propose the use of this nor any other structure on the property for business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an accessory structure not exceeding 1,600 square feet or 15' in overall height for thetaniszewski property at S94 W13674 Ryan Road in accordance to Section 4.05 (1) B and 6.1 1 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
