RESOLUTION #P.C. 137-2000
APPROVAL OF A 1,500 SQUARE FOOT ACCESSORY STRUCTURE FOR THE
GABRUS PROPERTY LOCATED AT SI03 W19061 KELSEY DRIVE (TAX KEY NO.
2285.999.01 1)
WHEREAS, A site plan and construction information was submitted by Kenneth Gabrus
to construct a 1,500 square foot accessory structure at the property located at S103
W19061 Kelsey Drive on June 28,2000, and
WHEREAS, The property is zoned R-1, Country Home District, where said structure is
a permitted accessory use and subject to Plan Commission review per Section 4.05 (2)
C. 1, and
WHEREAS, The total square footage for accessory structures is limited to 1 % of the
total land area and the property is allowed 2,396 square feet of total square footage of
accessory buildings, and no accessory structure currently exists on the property, and
said structure is proposed to be constructed with vinyl siding and an asphalt shingled
roof, and
WHEREAS, The location of the structure maintains all necessary offsets and setbacks,
the height is limited to 15 feet, the architectural appearance would be compatible with
the applicant's surrounding area, and the petitioners do not propose the use of this nor
any other structure on the property for business related activities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an accessory
structure not exceeding 1,500 square feet for the Gabrus property at S103 W19061
Kelsey Drive in accordance to Section 4.05 (1) B and 6.1 1 (2) and that subject
accessory structure not be used for the operation of a business nor the storage of
business related material or equipment.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per
violation, the initiation of legal action, or both.
