APPROVAL OF A 704 SQUARE FOOT ACCESSORY STRUCTURE FOR THE KOOK
PROPERTY LOCATED AT W138 S7122 SHERWOOD CIRCLE (TAX KEY NO.
2206.998.01 3)
WHEREAS, A site plan and construction information was submitted by Tom Kook to
construct a 704 square foot accessory structure at the property located at W138 S7122
Sherwood Circle on June 19,2000, and
WHEREAS, The property is zoned Rs-2, Suburban Residence District, where said
structure is a permitted accessory use and subject to Plan Commission review per
Section 4.05 (2) C.1, and
WHEREAS, The total square footage for accessory structures is limited to 1 % of the
total land area and the property is allowed 1,463 square feet of total square footage of
accessory buildings, and a 400 SF outbuilding currently exists on the property, and
said structure is proposed to be constructed with white, vinyl siding and an asphalt
shingled roof, and
WHEREAS, The location of the structure maintains all necessary offsets and setbacks,
the height is limited to 15 feet, the architectural appearance would be compatible with
the applicant's surrounding area, and the petitioners do not propose the use of this nor
any other structure on the property for business related activities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an accessory
structure not exceeding 704 square feet for the Kook property at W138 S7122
Sherwood Circle in accordance to Section 4.05 (1) B and 6.1 1 (2) and that subject
accessory structure not be used for the operation of a business nor the storage of
business related material or equipment.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per
violation, the initiation of legal action, or both.
