PCR2000119AMENDED RESOLUTION #P.C. 119-2000 APPROVAL TO AMEND THE BUILDING SITE AND OPERATION PLANS FOR E.J. JANESVILLE ROAD (TAX KEY NO. 2165.973) WHEREAS, Plans were submitted on June 1, 2000 and revised July 18, 2000 to amend an existing Building Site and Operation Plan to permit the installation of temporary lighting for the E.J. Salentine Buick-Pontiac property located at S66 W14444 Janesville Road (Tax Key No. 2165.973), and WHEREAS, The property is zoned 6-3, General Business, and whereas the existing use is a permitted conditional use, and WHEREAS, The Plan Commission approved of an amendment on June 17, 1999 in Resolution #PC 68-99 to allow a 20,996 SF building addition, and requires that the applicant apply for modification to Conditional Use within 120 days after notice from the City that final street reconstruction plans are approved, and WHEREAS, The petitioner proposes to install two (2) 20' high poles, and refit two existing poles to include fixtures at a 20 height and this height corresponds to the SALENTINE BUICK-PONTIAC AT THE PROPERTY LOCATED AT S66 W14444 primary roofline of the structure, and WHEREAS, Each pole is proposed to be fitted with a maximum of two downcast cutoff fixtures with 400-watt, high pressure sodium fixtures, and WHEREAS, A photometric plan has been submitted by the petitioner and is required to be reviewed by the City's consulting engineer, and WHEREAS, Said plan meets the City requirement to have high pressure sodium fixtures, and WHEREAS, Said request does not represent a substantial change under the existing conditional use and does not require a Public Hearing before the Planning Commission. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amendment to the existing Building Site and Operation Plan to permit the installation of temporary lighting for the E.J. Salentine Buick-Pontiac property located at S66 W14444 Janesville Road. BE IT FURTHER RESOLVED, That the fixtures shall be of the 90-degree, downcast variety. BE IT FURTHER RESOLVED, That prior to the issuance of Building Permits the photometric plan shall conform to City requirements relating to light trespass at property lines. BE IT FURTHER RESOLVED, That the applicant apply for modification to the Conditional Use Grant for the installation of permanent lighting. Said application shall be submitted to the City Planning Department within 120 days after notice from the City that final street reconstruction plans are approved. BE IT FURTHER RESOLVED, That the installation of permanent lighting improvements shall be completed prior to the re-opening of the reconstructed Janesville Road abutting the property. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas, building fapdes, and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission and that failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
