PCR2000102AMENDED RESOLUTION #P.C.102-2000 APPROVAL OF A CONCEPTUAL BUILDING SITE AND OPERATION PLAN FOR THE REDEVELOPMENT OF THE PARKLAND MALL PROPERTY FOR PARKLAND VENTURE LLC (TAX KEY 2198.984) WHEREAS, On May 30,2000 conceptual plans were submitted by Art Dyer for a building, site and operation plan for a mixed use development of the Parkland Mall property, and WHEREAS, Said plans include the removal of the existing mall structure and the development of a 31,000 square foot commercial structure, a 24,000 square foot commercial structure, a 16,000 square foot commercial structure, an 8,000 square foot restaurant, a 3,500 square foot addition to an existing bank, a 60 unit elderly housing structure, underground parking structures, and common areas including a pavilion, and @ WHEREAS, Said property is currently zoned 8-4 Highway Business District and OPD Planned Development Overlay District, and said plan conform to the zoning district requirements, except for the 60 unit elderly housing structure WHEREAS, the adopted 2005 Comprehensive Plan envisions the use of the property for uses consistent with the 8-4 / OPD District, and WHEREAS, the draft 2010 Comprehensive Plan envisions the use of the property for uses consistent with the B-4 / OPD District, with the addition of residential uses, with buildings being located at the base setback line, and with increased pedestrian accommodations, and WHEREAS, the conceptual Building Site and Operation Plan has been reviewed by the Planning Department and comments have been provided in the form of Supplement #PC 102-2000. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the conceptual building, site and operation plan submitted May 30, 2000 by Art Dyer for a mixed use development at the Parkland Mall property. BE IT FURTHER RESOLVED, That this approval incorporates the review comments a provided by the Planning Department in the form of Supplement #PC 102-2000, which is attached hereto as Exhibit “A’ BE IT FURTHER RESOLVED, That architectural renderings must conform to the standards of the Downtown Design Guide. BE IT FURTHER RESOLVED, That the Plan Commission will be receptive to Zoning Code and Map amendments necessary to accommodate a sixty unit elderly housing structure. BE IT FURTHER RESOLVED, that this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission. Sandi Asti, Recording Secretary for office use only 12345 New Document 12345 AMENDED RESOLUTION #P.C. 101A-2000 APPROVAL OF A 700 SQUARE FOOT ACCESSORY STRUCTURE FOR THE DIX PROPERTY LOCATED AT S72 W19371 RICHDORF DRIVE (TAX KEY NO. 2189.091) WHEREAS, A site plan and construction information was submitted by Richard Dix to construct a 700 square foot accessory structure at the property located at S72 W19371 Richdorf Drive on May 17,2000, and WHEREAS, The property is zoned Rs-2, Suburban Residence District, where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.l, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable first floor area of the residence and the property is allowed 705 square feet of total square footage of accessory buildings, and a no outbuildings currently exist on the property , and said structure is proposed to be constructed with tan vinyl siding, blue trim, and an asphalt shingled roof, and WHEREAS, The location of the structure maintains all necessary offsets and setbacks, the height is limited to 12 feet, the architectural appearance would be compatible with 0 the applicant's surrounding area provided that roof eaves are installed and the site is intensively landscaped, and the petitioners do not propose the use of this nor any other structure on the property for business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of an accessory structure not exceeding 700 square feet for the Dix property at S72 W19371 Richdorf Drive in accordance to Section 4.05 (1) B and 6.1 1 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, The structure shall be located at least 15' from the east property line. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
