PCR2000094RESOLUTION #P.C. 094-2000 W APPROVAL OF A TWO (2) LOT SKETCH LAND DIVISION FOR THE LOWE PROPERTY LOCATED IN THE NE % OF SECTION 18 (TAX KEY NO. 2229.992.006) WHEREAS, A sketch was submitted by Rufus Lowe on May 3, 2000, for a two (2) lot land division in the NE % of Section 18, of the Lowe property, Tax Key No. 2229.992.006, and WHEREAS, The proposed land division would create two (2) lots, with each a minimum of 3.25 acres, and WHEREAS, In 1993 petitioner received approval to subdivide two residential parcels totaling approximately 63,500 square feet, from the subject lands under the auspices of an OPD - Planned Development District, and the Zoning Code requires all residential Planned Development Districts to be a minimum of 200,000 square feet in area. and WHEREAS, Subject property is zoned RS-1, Suburban Estates, requiring a minimum lot size of 30,000 square feet and an average minimum width of 120 feet, and said parcels meet the minimum zoning requirements, and WHEREAS, Said lots have access to City's sewer service and water, and WHEREAS, A 120 road extension is proposed to provide access to the proposed parcels, and petitioner requests permission to access the parcels by private driveway to be constructed within the unimproved roadway, and u WHEREAS, There is no record that the subject road extension connects to a dedicated or reserved right-of-way, and WHEREAS, The proposed land division would result in four parcels being served by a single access drive, and adopted Public Works Policy requires a fully improved street constructed to City Specifications be installed to serve four parcels, and WHEREAS, The adopted 2005 Comprehensive Plan depicts this area for medium density residential development and this proposal meets this goal, and WHEREAS, wetlands and unmapped floodplains may exist on the property. THEREFORE BE IT RESOLVED, That the Plan Commission approve of a sketch land division being submitted creating a two (2) lot land division in the NE % of Section 18 of the Lowe property. L-,
