RESOLUTION #P.C. 0846-2000
DETERMINATION OF USE CLASSIFICATION OF
COMMUNITY BASED RESIDENTIAL FACILITIES
WHEREAS, on April 6, 2000, a request for zoning classification for a sixteen unit
Community Based Residential Facility was received by Joanne Gorenc, and
WHEREAS, Section 5.01(2)(c) of the Municipal Zoning Code indicates that, “In case of
questions as to the classification of use, the question shall be submitted to the Plan
Commission for determination“, and
WHEREAS, Wisconsin Statutes require that facilities with 9 to 15 residents be
permitted in residential zones, and
WHEREAS, The Zoning Code currently allows nursing homes in RCE, R-1 , R-2, R-3,
RS-1, RS-2, RS-3, and RSE Districts, by conditional use grant, and the Plan
Commission finds it logical to parallel this zoning scheme, as the facilities have much in
common on terms of physical impact, and
WHEREAS, The Plan Commission believes that the bulk requirements of the Zoning
surroundings.
THEREFORE BE IT RESOLVED, That the Plan Commission determines that
Community Based Residential Facilities be permitted by Conditional Use Grant in the
RCE, R-I, R-2, R-3, RS-1, RS-2, RS-3, RSA, and RSE Districts.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping andlor asphalting, a bond, letter of credit or cashiers check equal to twice
the value of said costs must be submitted to the Planning Department.
