PCR2000083RESOLUTION #P.C. 083-2000 APPROVAL OF A CONDITIONAL USE GRANT AND BUILDING SITE AND OPERATION PLAN FOR INDOOR VEHICLE STORAGE AND MAINTENANCE FOR AAA ASPHALT SEALING INC. AT A PROPERTY LOCATED IN THE SE Z OF SECTION 30 (TAX KEY NO. 2280.999 / S99 W20523 PARKER DRIVE) e WHEREAS, A request was submitted by Bryon Hrin on behalf of AAA Asphalt Sealing for a conditional use grant and building, site and operation plan for vehicle storage and maintenance at a property located in the SE Z of Section 30, on March 14, 2000, and WHEREAS, Said property is currently zoned EA - Exclusive Agricultural District, and use of the property for indoor storage is permitted by Conditional Use Grant, and WHEREAS, Petitioner proposes to use the property in conjunction with the operations of AAA Asphalt Sealing, and uses would include indoor storage of eight (8) vehicles, three (3) trailers, and operations would include incidental maintenance of said vehicles, and WHEREAS, Petitioner has not identified hours of operation, and WHEREAS, Petitioner has proposed no modification to driveways and access, and a WHEREAS, Petitioner proposes no change in exterior appearances of existing structures and no change in exterior lighting, and WHEREAS, Petitioner has not submitted Material Safety Data Sheets (MSDS) for items to be stored on premises, and WHEREAS, Petitioner proposes to purchase approximately 35 acres, more or less, of the 79 + acre parcel, and petitioner must supply a revised legal description. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a conditional use grant and building, site and operation plan submitted March 14, 2000 by Bryon Hrin on behalf of AAA Asphalt Sealing for indoor vehicle storage and maintenance at the property located in the SE Z of Section 30, described as Tax Key No. 2280.999. BE IT FURTHER RESOLVED, That Material Safety Data Sheets be provided to the Planning Department prior to commencement of operation on the site, and shall also be provided on an annual basis. BE IT FURTHER RESOLVED, That a correct legal description be provided by petitioner within 30 days of the approval of this Resolution, or all approvals shall be null 0 and void. i Resolution #PC 083-2000 BE IT FURTHER RESOLVED, That all storage and maintenance activities be restricted to take place within the accessory structures. Outdoor storage and maintenance activities are specifically prohibited. BE IT FURTHER RESOLVED, That the Plan Commission finds this use to be incompatible with the rural residential character and requires petitioner to record a deed restriction with the Waukesha County Register of Deeds which prohibits land divisions while this use is conducted from the subject property. BE IT FURTHER RESOLVED, That no modification to driveways and access is approved. BE IT FURTHER RESOLVED, That hours of operation be limited to 7:OO AM to 6:OO PM Monday through Friday. BE IT FURTHER RESOLVED, That the residential structure shall not be used for any 'business purpose. BE IT FURTHER RESOLVED, That operations shall not be conducted which require customers to enter upon the property. BE IT FURTHER RESOLVED, That no signage is included in this approval BE IT FURTHER RESOLVED, That this Conditional Use grant shall be reviewed by the Plan Commission on an annual basis beginning one (1) year from the date of this approval and any operations which are deemed to be inconsistent with this approving resolution may be subject to further conditions by the Plan Commission. m BE IT FURTHER RESOLVED, That at the call of the Plan Commission Chairman, the operations subject to this conditional use grant may be subject to further review by the Plan Commission, and any future operations which are deemed to be inconsistent with this approving resolution may be subject to further conditions by the Plan Commission. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.
