APPROVAL OF BUILDING SITE AND OPERATION PIAN
FOR ARBYS RESTAURANT FOR COLLEY & ASSOCIATES, LLC.
AT THE PROPERTY LOCATED AT S73 W16770 JANESVILLE ROAD
WHEREAS, Plans were submitted by Cooley & Associates, LLC for a building,
site and operation plan for an Arby’s restaurant located S73 W16770 Janesville Road
on March 24, 2000, and
WHEREAS, Said property is currently zoned E4 Highway Business District, and
OPD Planned Development District and use is a permitted use by right, and
WHEREAS, Petitioner proposes to construct a 250 square foot addition to the
existing structure, and proposed substantial architectural modification to the existing
structure, and
WHEREAS, The existing structure is composed of face brick glass, and shingled
roof which conform to the material standards of the adopted Downtown Design Guide,
and
WHEREAS, The existing structure represents three sided architecture which is
not in conformance with the Downtown Design Guide requirement for four sided
architecture, and
0 WHEREAS, Petitioner proposes to reface the exterior of the existing structure in
conjunction with the building addition, with materials including glass, brick veneer,
painted brick, synthetic plaster, back-lit awnings, and a reduced roof line, and certain
materials including synthetic plaster and painted brick are not in conformance with the
standards of Downtown Design Guide, and
WHEREAS, Petitioner proposes three sided architecture which is not in
conformance with the Downtown Design Guide requirement for four sided architecture,
and
WHEREAS, Existing traffic patterns and parking accommodations are proposed
to be utilized and are in conformance with zoning code requirements, and
WHEREAS, The Plan Commission has set the precedent of prohibiting the use
of amplified speakers and ordering systems for drive through restaurants, where such
uses are in proximity to residential areas, and the subject property abuts residential
lands to the north, and
WHEREAS, Site plan changes are required to accommodate any increase of
stormwater generated by the building addition, such plans require the approval of the
City Engineer and Public Works Committee. and have not been submitted bv oetitioner.

WHEREAS, Petitioner has submitted plans which illustrate the removal of the
existing monument sign and illustrate the location of a new pylon sign, but detailed sign
plans have not been submitted by petitioner, and pylon signs are not in conformance
wlth the standards of the Downtown Design Guide, and
WHEREAS, Petitioner has submitted landscaping plans which illustrate
appropriate locations for plantings, but which do not identify certain species, and
WHEREAS, Petitioner indicates the reconstruction and relocation of refuse
enclosures and such plans do not appear to be adequately sized to accommodate the
use, and do not reflect the use of materials which compliment the structure, as required
by the Downtown Design Guide.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the
building, site and operation plan submitted March 24, 2000 by Cooley 8 Associates
LLC for an Arby's restaurant at S73 W16770 Janesville Road.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the
Building Department and that all aspect of this plan as they relate to landscape areas
and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan
Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the
completion of landscaping andlor asphalting, a bond, letter of credit or cashiers check
equal to twice the value of said costs must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval
contained in this resolution shall result in the imposition of fines of $100 per day, the
initiation of legal action, or both.
