APPROVAL OF A 10 X 12' ACCESSORY STRUCTURE FOR
THE GEBHARD PROPERTY LOCATED AT S63 W13100 WINDSOR DRIVE
(TAX KEY NO. 2161 168)
WHEREAS, A site plan and construction information was submitted by Michael
Gebhard to construct a 10' x 12' (120 square foot) accessory structure at the property
located at S63 W13100 Windsor Drive on March 14,2000, and
WHEREAS, The property is zoned Rs-2, Suburban Residence District, and
where said structure is a permitted accessory use and subject to Plan Commission
review per Section 4.05 (2) C.1, and
WHEREAS, The total square footage for accessory structures is limited to 60%
of the livable first floor area of the residence and the property is allowed 714 square
feet of total square footage of accessory buildings, and
WHEREAS, An 81 square foot outbuilding currently exists on the property, and
WHEREAS, The location of the structure requires a 15' offset on the west
property line and a 20' offset on the north property line, and said proposal does not
meet this requirement, and
WHEREAS, The height is limited to 14.5 feet, the architectural appearance
would be compatible with the applicant's surrounding area, and the materials submitted
are complimentary to the principal structure, and the petitioners do not propose the use
of this nor any other structure on the property for business related activities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a
compatible size structure not exceeding 120 square feet for the Gebhard property at
S63 W13100 Windsor Drive in accordance to Section 4.05 (1) B and 6.1 1 (2)
BE IT FURTHER RESOLVED, That this approval is subject to the accessory
structure being located as to abide by the required offsets within 90 days of this
approval.

-8 BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per
violation, the initiation of legal action, or both.
