PCR2000060e RESOLUTION #P.C. 60-2000 APPROVAL OF AN ANNUAL REVIEW FOR THE CONDITIONAL USE FOR A SALES AND SERVICE ESTABLISHEMENT FOR AUTOMOBILES, MORE SPECIFICALLY THE PARKING OF RENTAL VEHICLES, FOR ERDMANN MOTORS AT THE PROPERTY LOCATED IN THE NE % OF SECTION 25 WHEREAS, The Plan Commission approved a Conditional Use Grant for the parking of rental vehicles on a vacant property on the southeast corner of Loomis Road and North Cape Road (USH 45) across from Erdmann Motors on February 16, 1999, and WHEREAS, Previously approved plans permit a maximum of ten (10) rental units to be parked at the site on the southeast corner of the intersection on an 18' x 20 cemented pad area with an annual review of the property's status, and WHEREAS, That monthly reviews by staff will be conducted to assure that petitioner stays in compliance and will retain reports on monthly reviews and at the end of the year; Plan Commission will review reports to determine if petitioner has stayed in compliance or been in violation, and WHEREAS, The annual review has determined the property to be non-compliant for the following issues: 1 Sign located in the required northwest vision corner of the intersection. 2. Banners were not previously approved by the Plan Commission. 3. Salable automobiles required to be located on the NW corner have been 4. Rental vehicles required to be located on the SE corner have been relocated relocated to the SE corner to the NW corner and, WHEREAS, The petitioner is requesting to move the rental vehicles to the northwest corner of Loomis Road and North Cape Road, and relocate the salable vehicles to the southeast corner, and the Plan Commission must determine whether to consider this to be a significant change to the existing Conditional Use Grant. RESOLUTION #P.C. 60-2000 THEREFORE BE IT RESOLVED, The Plan Commission considers the petitioner’s request to relocate the rental vehicles and the salable vehicles a significant change to the existing Conditional Use Grant, and such change will require a separate Public Hearing prior to consideration by the Plan Commission. I BE IT FURTHER RESOLVED, That prior to April 4, 2000 the vehicles must be relocated and parked in accordance with approved Conditional Use Grants or the Plan Commission may take action on non-compliance including but not limited to fines, revocation of Conditional Use grants, or both. BE IT FURTHER RESOLVED, That the banners and sign in the vision corner must be removed prior to April 4, 2000, and the site will be in compliance with the previously approved Conditional Use Grant or the Plan Commission may take action on non-compliance including but not limited to fines. BE IT FURTHER RESOLVED, That in accordance with the conditions of previously approved Conditional use Grants, the Plan Commission approves of the annual review for a conditional use for the purpose of sales and service of automobiles, more specifically the parking of rental vehicles, at the property located in the southeast corner of the intersection of Loomis Road and North Cape Road (USH 45) across from Erdmann Motors, for Erdmann Motors. BE IT FURTHER RESOLVED, That previously approved plans are kept on file in 0 an address file in the Building Department and all aspect of this plan shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both.
