RECOMMENDATION OF REPEAL OF SECTION 2.02 (5) AND SECTION 6.03(l)(d)
AND CREATION OF SECTION 6.14 OF CHAPTER 17, ZONING, ENTITLED
"FIRST AMENDMENT PROTECTED ADULT ORIENTED ESTABLISHMENTS
WHEREAS, Sections 2.02(5) and 6.03(l)(d) of the Zoning Ordinance regulate
Adult-oriented Establishments as uses allowed by conditional grant in the 1-1 Industrial
Park District and 1-2 General Industrial District, and
WHEREAS, The City Attorney has recommended repeal and recreation of these
Sections as a result of recent Court decisions, and
WHEREAS, The City Attorney has recommended that the attached code
provisions, including provisions to Chapter 12, Licensing, be adopted, and
WHEREAS, Said provisions require the Plan Commission to recommend the
zoning districts where Adult Oriented Establishments may be permitted subject to
license approval by the Common Council.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby
recommend the repeal of Section 2.02 (5) and 6.03 (1) (d) of the Zoning Code to the
Common Council. a BE IT FURTHER RESOLVED, That the Plan Commission recommends the
adoption of Section 6.14 as attached hereto, and that Section II (1) state that licensed
establishments are permitted by right in the 1-1 Industrial Park District and 1-2 General
Industrial District.
