APPROVAL OF A THREE (3) LOT SKETCH LAND DIVISION FOR THE
HENNEBERRY PROPERTY LOCATED IN THE SW X OF SECTION 20
(TAX KEY NO. 2236.996 I HENNEBERRY DRIVE)
WHEREAS, On January 4, 2000 a sketch was submitted by Brian Henneberry
for a three (3) lot sketch land division of the Henneberry property located in the SW X
of Section 20, (Tax Key No. 2236.996), and
WHEREAS, The proposed land division would create lots with a minimum area
of four (4) acres and an average minimum width of 250 feet, and
WHEREAS, Said property is zoned EA - Exclusive Agriculture District, and
petitioner proposes to rezone the subject land to RCE Residential Country Estate
District, requiring a minimum lot size of 120,000 square feet and an average minimum
width of 250 feet, and parcel does not meet said minimum zoning requirements for lot
width, and
WHEREAS, Said Land divisions will result in a 22 acre remnant parcel which
does not meet the standards of the EA District, and which will be rezoned to A -
Agriculture District concurrent with the Final CSM approval.
e WHEREAS, The Land Use 2005 Plan depicts this area as being set aside for
rural density residential development and this proposal is within this goal, and
WHEREAS, Said parcels will be serviced by private sewer and water facilities,
and
WHEREAS, Wetlands are present on the subject parcels, and
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a
sketch Certified Survey Map being submitted creating a three (3) lot land division of the
Henneberry property in the SW % of Section 20.
BE IT FURTHER RESOLVED, That the 22 acre remnant parcel may be excluded
from the Certified Survey Map.
BE IT FURTHER RESOLVED, That this approval is granted in concept only and
final action is only an indication of the current intent of the Plan Commission; Final
submittals are subject to future review and consideration by the Plan Commission,
municipal committees of jurisdiction, and other agencies, and approval of final plans is
not guaranteed by this action of the Plan Commission.
BE IT FURTHER RESOLVED, That all wetlands are required to be delineated
on the Final Certified Survey Map.
