PCR20000110 RESOLUTION #P.C. 011-2000 APPROVAL OF A CONCEPTUAL BUILDING, SITE AND OPERATION PLAN FOR KINGDOM DAY CARE LOCATED IN THE SE % OF SECTION 9 (TAX KEY NO. 2196.957.001 / S7S W17461 JANESVILLE ROAD) WHEREAS, Plans were submitted by Mike and Diane Kostecki for a conceptual building, site and operation plan of the Kingdom Day Care located at S75 W17461 Janesville Road on December 15, 1999, and WHEREAS, The property is zoned B-3,General Business District, and the proposed use is not defined by the Zoning Code as permitted by right or conditional grant, and WHEREAS, The property contains an existing 2,968 square foot masonry structure to be rehrbished to accommodate the day care center, and WHEREAS, Interior alterations must be in conformance with all State and Federal Code and licensing requirements, and WHEREAS, A final Building, Site and Operation Plan which addresses outdoor lighting, signage, landscaping, and the parking lot must be approved by the Plan Commission prior to the operation of a day care center, and 0 WHEREAS, All required State and Federal licenses must be obtained prior to occupancy, and THEREFORE BE IT RESOLVED, The Plan Commission determines the proposed day care center use is permitted in the B-3 District by conditional use grant, and BE IT FURTHER RESOLVED, That the Plan Commission approves of a conceptual building, site and operation plan of the Kingdom Day Care located at S75 W17461 Janesville Road. BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and that all aspect of this plan as they relate to landscape areas building facades and drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be submitted to the Planning Department. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or both. Resolution 011-2000 Page 2 BE IT FURTHER RESOLVED, that this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
