RECOMMENDATION OF APPROVAL TO REZONE THE MW MARINE PROPERTY
INSTITUTIONAL AND PUBLIC SERVICE OVERLAY DISTRICT
LOCATED IN THE SW !4 OF SECTION 1

FROM 1-1, INDUSTRIAL PARK, TO I-l/OIP, INDISTRIAL PARK WITH THE
WHEREAS, On October 8, 1999 a petition for rezoning was submitted by Milwaukee
SMSA Limited Partnership to rezone the MW Marine property located at S63 W13951 West
College Avenue (Tax Key No. 2162.999) from 1-1, Industrial Park District to I-VOIP, Industrial
Park with the Institutional and Public Service Overlay District, and
WHEREAS, The total area to be rezoned would include approximately 7.5 acres to allow
for construction of monopole for a telecommunications facility which is permitted as a
conditional use, and
WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common
Council on November 23, 1999, and
WHEREAS, The subject property is subject to the provisions of the 2010 Arterial
Highway System Map, which illustrates the extension of Sunnyslope Road along the parcel
boundary, and which requires setbacks to be measured from the ultimate right-of-way line, and
WHEREAS, The adjacent properties are zoned 1-1, Industrial Park to the west, B-2, Local
Service Center, to the south, Rs-2/0IP, Suburban Residence with the Institutional and Public
Service Overlay District, to the east, and the City of New Berlin lies to the north, and
WHEREAS, The City of Muskego Land Use Plan for the Year 2005 anticipates this
specific area being set aside for industrial uses and the proposal is in keeping with the goals of
the 2005 Land Use Plan.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend
the rezoning of approximately 7.5 acres from 1-1, Industrial Park District to l-l/OlP, Industrial
Park with the Institutional and Public Service Overlay District to allow for construction of
monopole for a telecommunications facility.
