PCR1999124a RESOLUTION #P.C. 124-99 APPROVAL OF THE CONSTRUCTION OF A DECORATIVE POND FOR THE SCHWAB PROPERTY LOCATED AT S78 W16679 SPINNAKER DRIVE (TAX KEY NO. 2199.031) WHEREAS, A site plan and construction information was submitted by Bob Schwab to construct a decorative pond in the rear yard at S78 W16679 Spinnaker Drive, and WHEREAS, The property is zoned Rs-2 Suburban Residence District, and decorative ponds are a permitted accessory use and subject to Plan Commission approval, and WHEREAS, The subject area is within a storm water drainage easement, and the Public Works Committee has reviewed and approved the proposal on September 27, 1999, and WHEREAS, The petitioner proposed to install weed barriers and pea gravel in the bed of the water feature in order to maintain aesthetics and limit nuisance vegetation, and WHEREAS, Petitioner proposes decorative accessory structures such as walking bridges and a windmill which are not within the review authority of the Plan Commission, but which the Public Works Committee has required to be anchored to avoid the potential for said structures to become buoyant during occasions where heavy rain events fill the storm water area. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a decorative pond in the rear yard at S78 W16679 Spinnaker Drive, subject to petitioner’s control of nuisance weeds in perpetuity. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
