APPROVAL OF CONCEPTUAL REZONlNG FOR A
DUPLEX OVERLAY DISTRICT FOR LYNN KURER AT THE PROPERTY
LOCATED TN THE NE % OF SECTION 14
(TAX KEY NOS. 2213.995.001 AND 2213.995.001)
WHEREAS, A request for Duplex Overlay in a RS-2, Suburban Residence District was
submitted by Lynn Kurer at the property located in the NE % of Section 14 (Tax Key Nos.
2213.995.001 and 2213.995.001), and
WHEREAS, The lot contains an accessory structure and has no home on the parcel
grounds, and
WHEREAS, The petitioner proposes to build a duplex residence and reconfigure and
expand the parcel to accommodate the Duplex Overlay zoning requirements, and
WHEREAS, The properties are currently zoned RS-2, Suburban Residence, and both
properties are one (1) acre in size, and
WHEREAS, Both properties do not appear to meet the requirements for the Duplex
Overlay District requiring the average minimum lot width to be twice the width required in the
underlying zoning district, and e WHEREAS, The properties to the north are zoned RS-2 and further north included the
RS-2 zoning with a Highway Service Overlay and the land use includes several residences,
including a duplex farm house and a three family residence, and a vacant tavern, and
WHEREAS, The properties to the west include RS-2 zoning and Office-Specialty Service
Overlay zoning and the land use includes several storage barns, two old taverns and vacant land
area, and
WHEREAS, The property to the south is zoned partially RS-2, R-2, and further south
includes designated Shoreland-Wetland zoning and the land use includes some residences, vacant
land area, trap shooting ranges and conservancy area, and
WHEREAS, The property to the east is zoned RS-2 and the land use includes open
agricultural land, and
WHEREAS, The Comprehensive Plan depicts this area to maintain an agriculturdrural
setting, and the 2010 Highway System Plan realigns Durham Drive to cross east of the property.
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a conceptual
rezoning for a Duplex Overlay for the property of Lynn Kurer located in the NE % of Section 14
0 (TaxKey Nos. 2213.995.001 and 2213.995.001)
0 BE IT FURTHER RESOLVED, that this approval is granted in concept only and final
action is only an indication of the current intent of the Plan Commission; Final submittals are
subject to future review and consideration by the Plan Commission, municipal committees of
jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the
Plan Commission.
