APPROVAL OF A THREE (3) LOT CERTIFIED SURVEY MAP AND REZONING
FOR THE POSBRIG PROPERTY LOCATED IN THE SW ”4 OF SECTION 21
(TAX KEY NO. 2243.992)
WHEREAS, On September 24, 1999 a certified survey map was submitted by Carl and
Bonnie Posbrig for a three (3) lot land division of the Posbrig property located in the SW ’/i of
Section 21, (Tax Key No. 2243.992), and
WHEREAS, The proposed land division would create lots with a minimum area of 4.2
acres and an average minimum width of 200 feet, and
WHEREAS, Said property is zoned EA, Exclusive Agriculture District, and the petitioner
proposes to rezone the properties to R-1, Country Home District, and
WHEREAS, The proposed rezoning is compatible with the surrounding properties, and
WHEREAS, The petitioner has received the proper wetland delineation of the property by
SEWRPC on October 19, 1998, and
WHEREAS, The petitioner has received approval for a wetland crossing from the DNR,
and
0 WHEREAS, The Land Use 2005 Plan depicts this area as being set aside for agricultural and rural development and the Land Use Plan is required to be amended to accommodate
suburban residential low density development, and
WHEREAS, Said parcels will not be serviced by City sewer and water
THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to
the Common Council of a Certified Survey Map for a three (3) lot land division of the Posbrig
property located in the SW 5’4 of Section 21 subject to resolution of technical discrepancies as
identified by the City Engineers, and payment of all applicable fees in Section 18,14(3) of the
Land Division Ordinance, and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the Plan Commission recommends approval to the
Common Council for the rezoning of the Posbrig properties from EA, Exclusive Agriculture
District, to rezone the properties to R-1, Country Home District to allow for construction of two
single-family residences.
BE IT FURTHER RESOLVED, That the 2005 Comprehensive Plan is amended to reflect
the subject parcel’s recommended land use is “low density suburban residential”
BE IT FURTHER RESLOVED, That a DXF file of this CSM be submitted to the City on 0 3 %” diskette prior to City signatures being place upon the CSM.
