PCR19991190 AMENDED RESOLUTION #P.C. 119-99 APPROVAL OF A SKETCH PRELIMINARY PLAT FOR AN EIGHT (8) LOT SUBDIVISION BY AAA ASPHALT SEALING LOCATED IN THE SW 114 OF SECTION 25 WHEREAS, A sketch for a preliminary plat was submitted by AAA Asphalt Sealing for the Kaiser and Baillargeon properties located in the SW 114 of Section 25, on September 24, 1999, and WHEREAS, Said sketch preliminary plat consist of approximately 13 acres, and proposes eight (8) lots, ranging from one acre to 3.85 acres in size, and WHEREAS, Said property is zoned RSE Suburban Residence District, requiring a minimum lot size of 40,000 square feet and an average minimum width of 150 feet, and said lots appear to meet said minimum zoning requirements, and WHEREAS, The Land Use 2005 Plan depicts this property for planned unit development, and WHEREAS, Said property will be serviced by City sewer and will access water through private wells, and e WHEREAS, said property includes frontage on State Trunk Highway 36 and Loomis Drive, and direct vehicle access to Highway 36 right-of-way is prohibited, and WHEREAS, said property contains wetlands, and delineation of wetland boundaries will be required prior to preliminary plat approval, and WHEREAS, said property contains a natural watercourse, and a determination of navigability will be required prior to preliminary plat approval, and WHEREAS, said property is in proximity to the Superior Emerald Park Landfill, and the City of Muskego desires full disclosure of the nature and effect of this use to all potential lot buyers, THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 13 acre, 8 lot, sketch preliminary plat for AAA Asphalt Sealing for the Kaiser and Baillargeon properties located in the SW 1/4 of Section 25 and will be receptive to the submittal of a preliminary plat. BE IT FURTHER RESOLVED, That prior to submittal of a preliminary plat the subdivider shall have all wetlands delineated by SEWRPC or an authorized firm, and said boundaries shall be illustrated on the face of the plat. BE IT FURTHER RESOLVED, That prior to submittal of a preliminary plat the subdivider shall request a determination of navigability from the DNR and the results submitted to 0 the Planning Department for consideration. 0 BE IT FURTHER RESOLVED, That direct vehicle access to State Trunk Highway 36 is prohibited. BE IT FURTHER RESOLVED, That the subdivider shall be required to place deed restrictions on all lots within the plat which shall be binding upon all of subdivider’s successors or assigns, which identify the plat’s proximity to Superior Emerald Park Landfill, and which indemnify the City of Muskego and its elected and appointed officials from and claims for damages relating to the siting ofthe subdivision in proximity to the landfill. BE IT FURTHER RESOLVED, that this approval is granted in concept only and final action is only an indication of the current intent of the Plan Commission; Final submittals are subject to future review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
