PCR1999116RESOLUTION #P.C. 116-99 RECOMMENDATION OF APPROVAL OF A CERTIFIED SURVEY MAP FOR '/i OF SECTION 9 (TAX KEY N0.2193.998.001) * A TWO (2) LOT LAND DIVISION FOR THE MERCER PROPERTY LOCATED IN THE NE WHEREAS, A certified survey map was submitted by Michael Mercer for a Two (2) lot land division of the property commonly known as W175 S7201 Lake Drive, located in the NE '/i of Section 9, on September 10, 1999 and WREAS, Said property is zoned RS-3 / OLS, Suburban Residential District and Lakeshore Overlay District, WHIZREAS, Said Certified Survey Map substantially conforms to that of the Plan Commission's previously approved sketch land division by Resolution PC# 93-99, and WHEREAS, The Land Use 2005 Plan depicts this area for medium density residential development, and the use of the property for residential purposes is consistent with the Plan, and WHEREAS, Said parcels will be serviced by City sewer and will access water through private wells, and WHEREAS, Lot I of the sketch CSM contains a detached accessory structure and said a structures are not permitted to remain without a principal structure being present on the lot, THEREFORE BE IT RESOLVED, That the Plan Commission recommends approval to the Common Council of a Certified Survey Map for a Two (2) lot land division of the Mercer property located in the NE '/i of Section 9 subject to resolution of technical discrepancies as identified by the City Planning Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if applicable. BE IT FURTHER RESOLVED, that the accessory stmcture on lot 1 be removed no later than the sale of the property, or one year from the date of Common Council approval of the final certified survey map, which ever occurs first. BE IT FURTHER RESOLVED, That a DXF file of this CSM be submitted to the City prior to City signatures being placed upon the CSM (3-1/2" diskette).
