APPROVAL. OF A TWO (2) LOT SKETCH LAND DIVISION AND CONCEPTUAL REZONING
FOR THE BACHLEITNER PROPERTY LOCATED IN THE NE % OF SECTlON 13
(TAXKEY NO. 2209.9661 S81 W12775 ACKER DRIVE) 0
WHEREAS, On August 6, 1999 a sketch was submitted by Robert and Joan Bachleitner
for a two (2) lot land division in the NE ‘/4 of Section 13, (Tax Key No. 2209.966 / Acker Drive),
and
WHEREAS, The proposed land division would create lots with a minimum area of 20,000
square feet and a minimum average width of 150 feet, and said lots would be in conformance with
the requirements of the RS-2 Suburban Residence District, and
WHEREAS, Said property is zoned RSE - Residential Suburban Estate District, requiring
a minimum lot size of 40,000 square feet and an average minimum width of 150 feet, and
WHEREAS, Certain residential parcels in proximity to petitioner’s property are classified
as being non-conforming with respect to the RSE zoning district requirements, but would be in
conformance with RS-2 zoning district requirements,
WHEREAS, The amended 2005 Comprehensive Plan depicts this area as being set aside
for low density rural residential development better described as being equal to or less than one
dwelling unit per acre, and petitioner’s proposed sketch land division and rezoning are in
compliance with this goal, and a WHEREAS, Said parcels are proposed to be serviced by municipal sanitary sewer.
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a two lot
sketch Certified Survey Map being submitted for the Bachleitner property in the NE % of Section
13, Tax Key No. 2209.966.
BE IT FURTHER RESOLVED, that concurrent with submittal of the final certified
survey map for approval the petitioner shall be required to file for a zoning map amendment to
request RS-2 Suburban Residence zoning for the subject area.
BE IT FURTHER RESOLVED, that this approval is granted in concept and is only an
indication of the present intention of the Plan Commission. Final action is subject to hture review
and consideration by the Plan Commission, municipal committees of jurisdiction, and other
agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
