PCR1999094RESOLUTION #P.C. 94-99 APPROVAL OF A FIVE (5) LOT SKETCH LAND DIVISION FOR THE LOUGHNEY PROPERTY LOCATED IN THE SW % OF SECTION 30 (TAX KEY NO. 2279.993 I KELSEY DRIVE) WHEREAS, On August 6, 1999 a sketch was submitted by John Loughney for a five (5) lot land division in the NE Vi of Section 30, (Tax Key No. 2279.993 IKelsey Drive), and WHEREAS, The proposed land division would create lots with a minimum area of 2.75 acres and a minimum average width of 250 feet, and WHEREAS, Said property is zoned Agricultural District, requiring a minimum lot size of 2.75 acres and an average minimum width of 300 feet, and WHEREAS, The amended 2005 Comprehensive Plan depicts this area as being set aside for low density rural residential development better described by the requirements of the RCE Residential Country Estate zoning district, and petitioner’s proposal is within this goal, and WHEREAS, The 2010 Street System Map illustrates Kelsey Drive to have a 100’ ultimate right-of-way width, and Crowbar Road to have an 80’ ultimate right-of-way width, and WHEREAS, Said parcels are proposed to be serviced by municipal sanitary sewer THEREFORE BE IT RESOLVED, That the Plan Commission approve of a five lot sketch Certified Survey Map being submitted for the Loughney property in the SW !4 of Section 30, Tax Key No. 2279.993 BE IT FURTHER RESOLVED, that the final certified survey map shall be required to illustrate the abutting rights-of-way to their ultimate width from centerline BE IT FURTHER RESOLVED, that a subdividers agreement shall be executed concurrent with final certified survey map approvals in order to address public utility and bike path installation requirements BE IT FURTHER RESOLVED, that concurrent with submittal of the final certified survey map for approval, the petitioner shall be required to file for a zoning map amendment to request RCE Residential Country Estate zoning for the subject lots. BE IT FURTHER RESOLVED, that this approval is granted in concept only and final action is subject to hture review and consideration by the Plan Commission, municipal committees of jurisdiction, and other agencies, and approval of final plans is not guaranteed by this action of the Plan Commission.
