PCR1999087RESOLUTION #P.C. 87-99 APPROVAL OF A 42’ X 83’ ACCESSORY STRUCTURE FOR THE McCLURG PROPERTY LOCATED AT W213 S7200 ANNE’S WAY (TAXKEY NO. 2186.999) WHEREAS, A site plan and construction information was submitted by Mike McClurg and Sam Racine to construct a 42’ X 83’ (3,486 square foot) accessory structure for the property located at W213 S7200 Anne’s Way (TaxKey No. 2186.999) on July 15, 1999, and WHEREAS, The property is zoned RCE, Country Estate District, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.1, and WHEREAS, The total square footage for accessory structures is limited to 1% of the total square footage of the property and said property contains 43.25 acres of area which would allow 18,840 square feet of total square footage of accessory buildings, and WHEREAS, One outbuilding currently exists on the parcel and conforms to the regulations of the district, and WHEREAS, Subject accessory structure is proposed to house horses, feed, and 0 machinery, and WHEREAS, The location of the proposed structure meets the minimum offset requirements for the zoning district, the ultimate height is limited to 25 feet, the architectural appearance would be compatible with the applicant’s surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible size structure not exceeding 3,486 square feet for the property located at W213 S7200 Anne’s Way (Tax Key No. 2186.999) in accordance to Section 4.05 (I) B and 6.11 (2). BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
