PCR1999086RESOLUTION #P.C. 86-99 APPROVAL. OF A 24’ X 38’ ACCESSORY STRUCTURE FOR THE ACKER PROPERTY LOCATED AT S85 W21175 JANESVJLLE ROAD (TAX KEY NO. 2232.984) WHEREAS, A site plan and construction information was submitted by Bonnie Acker to construct a 24’ X 38’ (912 square foot) accessory structure for the property located at S85 W21175 Janesville Road (Tax Key No. 2232.984) on July 21, 1999, and WHEREAS, The property is zoned NOHS, Agriculture and Highway Service Overlay District, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C. 1, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable square footage of the first floor of the residence and said first floor contains 1,428 square feet (748 SF associated with the tavern and 680 SF associated with the residence) of area which would allow 857 square feet of total square footage of accessory buildings, and WHEREAS, A shed currently exists on the parcel, and is to be razed upon the completion of the proposed structure, and WHEREAS, Subject accessory structure is proposed to be partially used for the storage of business related material, and WHEREAS, The location of the proposed structure must meet the minimum offset requirements for the zoning district, the ultimate height is limited to 60 feet, the architectural appearance would be compatible with the applicant’s surrounding area. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible size structure not exceeding 857 square feet for the Acker property located at S85 W21175 Janesville Road (Tax Key No. 2232.984) in accordance with Section 4.05 (1) B and 6.11 (2), with colors to match the principal structure. BE IT FURTHER RESOLVED, that the existing shed shall be raised within 60 days of completion of the new accessory structure, BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
