APPROVAL OF A SEVEN (7) LOT SKETCH LAND DIVISION FOR THE RENO BERG
PROPERTY LOCATED IN THE SE 'A OF SECTION 17
(TAX KEY NO. 2228.998)
WHEREAS, On July 9, 1999 a sketch was submitted by Mr Reno Berg for a seven (7) lot
land division of the property located in the SE Vi of Section 17, (Tax Key No. 2228.998), and
WHEREAS, The proposed land division would create six (6) residential lots with an
estimated minimum area of 70,000 square feet and an average minimum width of 107.5 feet, and
one park parcel of approximately IO acres in size with 30 feet of frontage on Woods Road, and
WHEREAS, Said property is zoned RS-2 Suburban Residence District, which permits
single family detached homes on 20,000 square foot lots with a minimum width of 110 feet, which
are served by sanitary sewer, and
WHEREAS, Said parcel is also zoned L - Lowland District and WF - Wetland and
Floodplain District, which limits the buildable area of the property, and
WHEREAS, the proposed sketch land division includes a request by petitioner to consider
OPD - Planned Development Overlay District zoning for said property in order to preserve the
lowland and wetland floodplain areas within a dedicated park land, and permit the construction of
a two-unit townhouse on each residential lot (1 2 dwelling units total), and
WHEREAS, The Land Use 2005 Plan depicts this area as being set aside for medium
density residential development, not exceeding 2.0 dwelling units per acre, and said request for
OPD zoning and townhouse development would result in a density of 0.6 dwelling units per acre,
and
WHEREAS. the proposed lots would be served by municipal sanitary sewer and water
facilities,
WHEREAS, The 2010 Street System Plan illustrates Woods Road to be an 80 foot wide
ultimate right-of-way width, and said right-of-way is currently dedicated to a 66 foot width,
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a sketch land
division creating six (6) residential parcels and one (I) park parcel for the Berg property in the SE
Vi of Section 17 (Tax Key No. 2228.998).
BE IT FURTHER RESOLVED, That the Final Plat shall illustrate the dedication of
Woods Road to its ultimate width.
BE IT FURTHER RESOLVED, That dedication of park lands shall be subject to Park
Board and Common Council approvals concurrent with the consideration of the Final Plat.
BE IT FURTHER RESOLVED, That the Final Plat shall illustrate the boundaries of
'@ wetlands and floodplains as surveyed by the DNR, SEWRPC, or authorized agency or surveyor.
BE IT FURTHER RESOLVED, that the Final Plat submittal be accompanied by a
subdividers agreement which addresses the cost responsibilities of public utility installations.
BE IT FURTHER RESOLVED, that approval is subject to petition by property owner
and grant by Common Council of OPD - Planned Development Overlay District Zoning, and
approval of the related planned unit development detail plan.
