PCR1999081RESOLUTION #P.C. 81-99 APPROVAL OF A 14’ X 16’ ACCESSORY STRUCTURE FOR THE LaLICATA PROPERTY LOCATED AT S82 W17673 BRENNAN DRIVE (TAX KEY NO. 2221,184) WHEREAS, A site plan and construction information was submitted by Anthony LaLicata to construct a 14’ X 16’ (224 square foot) accessory structure for the property located at S82 W 17673 Brennan Drive (Tax Key No. 222 1 184) on July 9. 1999, and WHEREAS, The property is zoned RS-2/0PD/OLS, Suburban Residence with Planned Development and Lakeshore Overlay District and includes areas within Floodway and Floodplain zoning districts, and WHEREAS, Said structure is a permitted accessory use when located outside of Floodway districts, subject to Plan Commission review per Section 4.05 (2) C. I, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable square footage of the first floor of the residence and said first floor contains 1,916 square feet of livable area which would allow 1,150 square feet of total square footage of accessory buildings, and WHEREAS, No outbuildings exist on the parcel, and WHEREAS, The location of the structure is outside of the mapped Floodway district, 0 must meet the minimum side offset for the zoning district, the ultimate height is limited to IS feet, the architectural appearance would be compatible with the applicant’s surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible size structure not exceeding 224 square feet for the LaLicata property located at S82 W17673 Brennan Drive (Tax Key No. 2221 184) in accordance to Section 4.05 (I) B and 6.1 1 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
