PCR1999080RESOLUTION #P.C. 80-99 APPROVAL OF A 20’ X 20’ ACCESSORY STRUCTURE FOR THE DOMNICK PROPERTY LOCATED AT W152 S7917 MYSTIC DRIVE (TAX KEY NO. 2214.994.006) WHEREAS, A site plan and construction information was submitted by Linda Domnick to construct a 20’ X 20’ (400 square foot) accessory structure for the property located at W152 ,57917 Mystic Drive (Tax Key No. 2214.994.006) on July 2, 1999. and WHEREAS, The property is zoned RS-2, Suburban Residence District, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C. 1, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable square footage of the first floor of the residence and said first floor contains 1,772 square feet of livable area which would allow 1.063 square feet of total square footage of accessory buildings, and WHEREAS, A IO’ x 12’ (120 square foot) shed currently exists on the parcel, and is in conformance with the municipal code, and WHEREAS, The location of the proposed structure must meet the minimum offset requirements for the zoning district, the ultimate height is limited to 15 feet, the architectural appearance would be compatible with the applicant’s surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities. THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible size structure not exceeding 400 square feet for the Domnick property located at W152 S7917 Mystic Drive (Tax Key No. 2214.994.006) in accordance to Section 4.05 (1) B and 6.1 1 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
