PCR1999060RESOLUTION #P.C. 60-99 APPROVAL OF A 14’ X 20’ ACCESSORY STRUCTLIRE FOR THE ClFALDl PROPERTY LOCATED AT W137 S6848 DUNSTAN COURT (Tax Key No.2163.033) WHEREAS, A site plan and construction information was submitted on May 7, 1999 by Anthony Cifaldi 111 to construct a 14’ X 20’ (280 square foot), approximately 12 foot tall accessory structure at the Cifaldi property located at W137 S6848 Dunstan Court, and WHEREAS, The property is zoned RS-2, Suburban Residence District, and where said structure is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.l, and WHEREAS, The total square footage for accessory structures is limited to 60% of the livable first floor area of the residence and subject’s residence contains approximately 1,366 square feet which would allow 820 square feet of total square footage ofaccessory buildings, and WHEREAS, One (I) outbuilding exists on the parcel to date and is to be removed, and WHEREAS, The location of the structure maintains all necessary offsets and setbacks, the ultimate height is limited to I5 feet, the architectural appearance would be compatible with the applicant’s surrounding area, and the materials submitted do not propose the use of this nor any other structure on the property for business related activities. e THEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible size structure not exceeding 280 square feet for the Cifaldi property located at W137 S6848 Dunstan Court in accordance to Section 4.05 (I) B and 6.1 1 (2) and that subject accessory structure not be used for the operation of a business nor the storage of business related material or equipment. BE 1T FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
