RECOMMENDATION OF APPROVAL TO REZONE CERTAIN LANDS WITHIN THE
PRIMARY AND SECONDARY PROTECTION ZONES OF MUNICIF'AL WELL NO. 7 TO
INCLUDE THE OWP OVERLAY WELLHEAD PROTECTION DISTRICT,
WHEREAS, Pursuant to Wisconsin Legislative Act 410 of 1984 and the requirements of
Wisconsin Administrative Code Section NR 811 16(5), Chapter 17:9.11 Overlay Wellhead
Protection District was created, and
WHEREAS, The residents of the City of Muskego depend exclusively on groundwater
for a safe drinking water supply, and
WHEREAS, It is recognized that certain land use practices and activities can seriously
threaten or degrade groundwater quality, and
WHEREAS, The intent of this overlay district is to protect the City of Muskego's
municipal water and well fields, and
WHEREAS, Upon the petition of the Public Utilities Committee, a public hearing has
been scheduled before the Common Council on March 23, 1999.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend
approval to the Common Council of the rezoning of certain lands within the primary and
secondary protection zones of municipal well no. 7 to include the OWP Overlay Wellhead
Protection district (a list of affected properties is attached hereto).
